Subject: Moving back to Canada with Girlfriend
  My girlfriend and I are currently working in the United States, but we would like to move back to Canada. She is a British citizen, I am a Canadian citizen. What steps do we need to take? Can we simply cross the border, get married and then file the necessary paperwork for her to obtain her permanent residency? Will she apply for a visitors visa when we cross the border? I want to make sure that her status in the country is always legal.

Ok, you´re going to run into a lot of problems if she comes in just to get married. Depending on where you are going to move to it might be more adventageous to get married in the states, then have her enter Canada with you, married, and apply for In Canada Permanent Residency (look it up on the CIC webpage, www.canada.gc.ca. The reason I say possibly get married before you come in, is they will seriously question your intent, and the last thing they want you to do is have her ´move up there as a visitor and not leave´. Additionally if you´re going to Ontario it takes a lot time to get a marriage certificate, in the states you can get it same day.

I am going through the same thing except for I am American and she is Candian. We came back to the USA to get married then I entered as her spouse and they gave me a 1 year visa to get my stuff together to apply for PR. It sounds hard, and its not neccessarily ´hard´, just time consuming. If you can afford it you might go with a lawyer, but like I said its not hard. Just seriously don´t play around at the border because they will not hessitate to deny her entry, they almost denied me before for ´visiting´.

I don´t know how it works specifically for british citizens because they are part of the commonwealth so I would called CIC. I completely understand wanting to keep her status valid. If all she does need is a Visitor Record (what I have) then she can get that at the Port of Entry, as I did. However, if she needs a real visa she will have to apply for one. If you are married she will be more likely to get it under the grounds that you are going to marry soon and you´re planning on applying for permanent residency.

Dandy_Lion, thanks so much for the advice. Unfortunately, getting married in the United States is not an option for us because we are both woman. :) No same sex marriages here - one of the main reasons we want to leave.

I´m originally from Ontario and we can legally marry there. I want to do this the right way, which is why I thought a visitor´s permit might work. Although, if she´s British, does she actually need one?

Another option is to start the sponsorship process while we live here in the United States - sponsoring her as a common law spouse. But I´m not sure how long that would take.

perhaps you might need to move first...and have her come for a visit! A long visit! I am pretty sure she does not need a visa because of her citizenship. Get married and then apply for her sponsorship? I have no idea... but there must be a reasonable way! Good luck.

Brenda...thanks for the advice. That actually was one option. I thought I could move back to Canada, possibly Toronto, find a place, set up ties and then have her come visit. Once she was here, we could get married and then start the sponsorship process. That would probably be the easiest plan.

I suggest you to go to the closest Legit Center. This meetings are run by gay people and I don´t know in another provinces, but the one in Vancouver is very helpful.
I think practically you can bring her as a visitor, marry her and apply.... I think if you have supporting documents of your relationship, that should not be a problem because if they ask you why you marry her few days after her visit you can show your documents when you were together in the States previously cohabitating or pictures of you together. And advice number two:::
Sometimes i read some posts in this forum and people may not be very well informed, so try to go to Mosaic or Legit in the closest gay Center, and ask for and Immigration Counselor.
Another thing is that when she gets in here she just should say that she´scoming to visit her friend , because if she says that you are her lover they may suspect she is intending to immigrate, anyways she would not be lying because a partenr is also your friend.
Good luck...you will have to wait a long time, so why bother waiting more that necessary...

i think all people who are applying In Canada Class came here as visitors usually, there´s nothing wrong with that.
