Thanks for the encouragement catocan, and thanks for the info typo!

While the officers do seem to have almost god-like discretion, CIC operates according to the Immigration and Refugee Protection Act. Every decision has to be based on the law, and officers cannot just make up their own arbitrary reasons for admissibility.

While I don´t intentionally mean to create friction, I´ve got to stand up if officers are twisting the law and hassling people because of personal vengence.

Also, the purpose of the immigration law is to benefit society in the long term. Regardless of the technicalities of the law, there´s no benefit to supressing a law-abiding visitor who is pumping US Dollars into Canada and supporting social projects.

Sharon,

Yes it is clear that this individual has not abided by the IRPA...however we should show a certain degree of professionalism and respect in replying to the post. If he is insisting on sturring up trouble, let´s be kind and not stoop to the same level.

I´m still trying to figure out why it would take THREE officers to pin someone down on the FLOOR and twist their arms if they weren´t putting up a fight.

Methinks there´s more to this story than is being told.

I have no mercy for those who do not play by the rules.

From plenty of life experience, I know that it takes a fair bit to provoke a border officer to act in such a manner.

From plenty of life experience. I know those who yell the loudest have the least merit to their complaint.

not stooping to his level whatsover. Just refusing to buy it.

Colin, seriously. Just what do you think you will achieve by challenging immigration and customs officers, part of whose job description is to make a judgment call on whether or not to let someone into the country? They don´t work for the tourism department, and your pumping US dollars into the Canadian economy was probably the farthest thing from their minds.

There is something to be said for quiet diplomacy, and would have probably got you a lot farther than a direct confrontantion with someone in a position of authority. At the very least, you would have been able to make your case to a higher channel later, either directly or through a lawyer.

Right now, all you have achieved is getting a red flag against your name and a case file that now has two incidents listed including your latest, more serious one that has potentially wrecked your chances of entering Canada for some time.

Anyway, what´s done is done. There´s no easy way back. Your best bet is to either handle it from here on through a lawyer, or write to the CIC, very politely, explaining the circumstances and providing both your paperwork and an apology.

Must be frustrating, but you can´t fight immigration personnel all by yourself. Kind´a like trying to confront a bunch of pitbulls. You can only stay on their good side.
(hey, sounds like my boss..)

I have learned that people will give you back the same respect you have offered them. It is a good life lesson to learn early, particularly when you must deal with people who have significant control over your choices.

Colin, if you want to be cut some slack, you do not start waiving the Immigration and Refugee act in a border officer face and try to teach them the law - it rarely works. In fact, it usually backfires.

you might want to let the dust settle a little bit, and give yourself some time to cool down before you attempt a rectification of the current situation.
