hi all.
pls inform me. i really concern about my case.
I have been overstayed since my OPT was expired about a year ago. I applied SW family class from buffalo NY. I am here with my wife and kids who were born in the US. I had sent my FBI fingerprint to CIC along with my SW application before my visa was expired, but I am worried if CIC will ask for another FBI fingerprint. They asked my friend to send them another fingerprint within 90 days.
My question is :
Does FBI have any connection with INS office and will contact them in order to get my status? I told my lawyer that it would be better if we stay in my home country and wait for CIC approval (to avoid any troubles, we never know). but he said that it will take alot longer and so complicated cause CIC in my country doesn´t serve interview for PR applicant, we have to go abroad to do so. Otherwise, it will only take 12-18 mos if we apply from buffalo, they may not need to interview us (he guaranteed or he return my payment in full).
FYI, I have never been convicted to any criminals and never gotten any tickets since I´ve been here.

no, there is not connection as far as I know between fbi & ins. One of my friends got his fingerpriniting done Jan05, he is iverstaying for last 12 years.
