Advice for J1 visa in USA

Subject: Advice for J1 visa in USA
  Hi! Folks, I hope you could help me with this one.

I wonder if a J1 in USA can apply (successfully) for canada immigration while in the USA. What happens to the home country requirement, especially when there is no waiver.

I will appreciate any response. Thanks to you all.

Rajeev, you can, but you will be in a soup if they want an interview. Also, you can convert J1 to an H1 after getting a waiver from Indian embassy

CIC reqires anybody who has been legally staying in the USA for at least 1 year to apply from Buffalo. Otherwise, you only can apply from your home country. It also takes up to 2 years to be approved, so it will cause you a problem in the future. Good Luck.

I had a J1 in US and now I am a canadian PR... So, yes you can.

CIC does not care on what status you are in the US. However, they will care if you cannot show up for an interview when asked for. If you think you can stay in the US for next 3 years at least then yes apply from US - otherwise apply from your country of origin.

And yes, you do have to wait 1 year before you can apply from the US
