  Hi Sharon,

For what I understand, and corecty me please if I´m wrong, your common-law/spouse tried/considered to apply under the family class but due to various obstacles decided to go under SW class.

I´m in the simmilar situation but I´m the one seeking PR. I considered both options and decided to go with SW because I have approx 93 points and the application is strong (I work for the Alberta Government, PhD from Canada, Canadian spouse, work experience, English proficency, etc). The only problem is the long waiting time and the fact that my work permit will expire in March 07. I applied in march 05 so I might get the PR in time, especially if the interview is waived. Still, there is a chance that I won´t have the PR in time to continue with my employment.

Buffalo answered one of my inquiries and sent a letter saying that it would be faster to go under the Family Class and that I have two options:
- to withdraw the application and reapply being sponsored or,
- to keep the SW application and to open another one under Family Class.

I don´t want to close the current application after 9 months of waiting and 1-2 months before the IA but I´ll send a family class application to Mississauga (38 days for sponsor approval). They will forward it to my home country CIC where the timeline is 3-7 months.

I didn´t know you can have two PR application opened in the same time. But according to CIC Buffalo it is possible. So in conclusion, if it helps, you might take a simmilar route (if time is a concern)

we did not even try a sponsorship application. In-Canada applications seem to be taking a long time at the moment. I am observing a lot of complaints. I don´t know the exact rules about dual application in this case. It would not surprise me that if you sent them a change of status letter (marriage certificate) they might see that you will qualify on 2 fronts and therefore waive that interview and save you some time.

wishful thinking is always good. I am sorry I cannot be more help.

ouch ouch ouch! heard horrible stories about change of status deals triggers a whole application process restart, even at the time of just being at the very final stage. Might want to double check on it to make sure.

a PR applicant is obligated to notify CIC of any change in marital status. not sure how our friend would get around it unless they did not marry and continued on the current application. I am not suggesting she file a formal sponsorship application simply because I am not 100% clear about the rules and I do not know if it is even to her advantage.

Sharon,

I don´t understand if you ansered to me or somebody else.
If it is for me, I already notified CIC about my marital status change back in July. I sent all the documents and that is when I asked for their advice.
By the way, I´m a guy.
