Subject: Rejected Applications
Has anyone of you heard or read about applications that were rejected under the spouse/common-law in Canada class? If so, would you mind sharing the info? My application´s being processed under this class. Although I believe that there are no grounds for my application to be rejected, I´d like to find out the reasons CIC would provide for possible rejections. Thanks!

Hi Still Waiting,
You should check Tachour´s story. Be warned, it´s a horrible story but just recently her husband was granted his visa from Morroco.
Here´s the link: http://www.immigration.ca/discussion/topic.asp?TOPIC_ID=5961

From what I´ve read and heard, every case is different because it´s up to the discretion of the immigration officer handling your case. But mostly they look at the genuiness of your relationship (based on how much documentation you provide), medicals and the police check. However, I recently read about a case where an application from India was rejected on the basis of a 5 year age difference, and a difference in educational background. So it´s really hard to say.

Are you overseas or inland?
Also, you can get more info on some of the criteria they use to evaluate your case in CIC´s Overseas Processing Manual: http://www.cic.gc.ca/manuals-guides/english/op/index.html

For inland: http://www.cic.gc.ca/manuals-guides/english/ip/index.html

Which Visa office are you processing through?

My husband is going to be interviewed, we just don´t know yet. It´s so hard not knowing what they are looking for. But I did request CAIPS, so hopefully that will give me an idea of what they are looking for.

Stephanie, my app´s being processed inland. When I submitted my application, I provided all documentation possible to prove that our marriage is genuine. There were phone records, plane tickets, photos, rental agreements and marriage certificate. I couldn´t think of anything else to submit to prove the authenticity of our relationship. My police clearances reflected that I have no records in the countries that I´ve lived in for the past years. Still, I have this fear that the CIC might reject my application.

I requested for FOSS mid-December. Hopefully, I´ll receive it by late January or early February.

This long wait is causing me sleepless nights.
