Subject: Questions about Spousal sponsorship
  Dear All,

I am a canadian permananet resident living in the US and planning to move there in January 2007. I want to sponsor my wife, who holds a Russian passport and is also in US on a student visa, for canadian permananet residentship. As far as I understand there are two possible options available to us:

Opt-1) After moving to Canada in Jan 2007, start her application process.

Opt-2) Start her application process now as an independeent applicant.

The questions I had for you are the following:

Ques-1) -> Is Option 2 as stated above possible ? i.e. can a spouse of a permananet resident start an application of his/her own independently ? Are there any issues related with the same ?

Ques-2) -> If option 2 is possible then which of the two would be the fastest, given our specific condition ?

First, when does your wife´s student Visa´s expire?

And will your wife be coming with you to Canada in January 2007 as well?

Second, let´s say you decide to go with the sponsorship, you need to decide whether you will be doing in-Canada or overseas sponsorship. However, because you are in the US, and you are not a Canadian citizen, you can´t apply untill you have returned to live in Canada. Only Canadian citizens can live outside of Canada while the sponsorship app. is being evaluated, see page 13 of guide to sponsorship.

Also, when you do the overseas application, it will be sent to Russia. So if your wife requires an interview, she may have to travel there.

I´m not sure what you mean by "Independent" application. Do you mean skilled worker?

And have you looked into work permits for her? You may be able to get one and then do an in-Canada sponsorship application, that way you can be together.

Thanks very much for your quick reply! we really appreciate it. Coming to your questions:

My wife´s student visa expires in 2009.

She would like to come with me to Canada, but she would have to apply for either a visitor or work visa. As far as we know, it is very difficult for the spouse of a permananet resident to get a visitor visa. We are guessing the same to hold true for work visa as well. Hence we want to choose a strategy so that she can enter Canada as soon as possible without the aforementioned hassels ...

So if I understand you correctly, if I do a overseas sponsorship after I have moved back to Canada .. she might have to go to Russia for an interview, even though she might be residing in US at that time on a student visa. SO does this mean that the Canadian Consulate in Russia will be processing my application to sponsor her ? if so then is there a way of knowing the typical time lines for such cases ?

Coming to our second option, WHat if she applies independently, i.e. as a skilled worker to the Canadian consulate in Buffalo, NY for a canadian permanent residentship and not wait for me to first go back to Canada and then start her over-seas sponsorship ? Is that possible provided she has the required number of points (more than 67). If so then which of the two options would be faster ?

Hi NatSac,

Yes you are right, getting a vistor´s visa or work permit may be difficult. So when is your wife finishing her studies?

About the overseas sponsoring, yes, your application will be processed by the Canadian Consulate in Russia. Actually, first you will apply to CIC in Mississauga, and they will assess if you are eligible to sponsor. Waiting times for that step are I think about 45 days now. Once you are accepted, your file will be transfered to Moscow, and they will make the final decision. They will also do a background check and assess the medical evaluation your wife will have to undergo.
The good news is, according to CIC´s website, 80% of sponsorship applications through Moscow are processed in 10 months. That´s not bad compared to a lot of other countries.

About the skilled worker, from what I know, it can be a much longer wait. And I don´t know if there are complications if your wife is living in the US while she applies for skilled worker to Canada. I don´t know a lot about that category, so you may want to post a specific question about that here.

if she has been admitted to the UNITED STATES for a period of one year or more, she can apply through Buffalo, NY.

Overall, sponsorship would be faster whether it´s incanada, or overseas when compared to skilled worker. If she can get a work permit, then she can be in canada on her work permit, and you can apply to sponsor her from inside. that way she can be working and be sponsored and not be away from you.

can the status of her application change from overseas initially to in-canada later. I am afraid she may not be able to find a job in canada by the time I start her sponsorship.

She has been in US for more than a year now. So if I sponsor her, then will her file go to Buffalo or Moscow ? Same question for her interview.

I think that she will have an option. I believe that the processing times for buffallo are 6-8 months for spousal and 1.5yrs to 3 yrs for SW.

Yes,if your wife is on status here in the US she can apply for a Canadian temporary resident visa.Just prove them the Canadian Consulate that she will be leaving Canada after the termination of her stay.Or if both of you decided to just stay there,since you are a permanent resident.She can change her status within CAnada.Change of status like get a work permit or student visa.In that way, she will be ask to go to Buffalo for interview.You have alot of options,for as long as you have a status in the US.
