Subject: Unemployed after applied as skilled worker
  Hi,

I have applied as a skilled worker to Canada. I have a degree in Bio-Tech and I have been working for the past 6 years. I just got a letter from Immigration Canada where they sent me the Medical which needs to be done. As well they have asked me to send them my current W2 (Tax form) and pay stubs and my old 2000-2004 W 2 forms.

The porblem I have is that I was laid off from my job on August 2005 and I am worried that if Immigration Canada find out, they will refuse my application. I have been looking for job but nothing is found yet. I am not sure what to do. Should I send them my August pay stub and tell them, I am out of work? Can you please please please advise me on this. Do you think being out of work is a ground for rejection. I have all the qualification but I just lost my job. Please, I have 90 days to get back to them...Please respond back to this

Dear AH,

Firstly what they will look into is your current status in Canada. If you are living illegally, then you will be in trouble. So first of all try to maintain your status. If you are living in Canada legally, then no problem! The main thing is you should have enough funds to survive you and your family. Dont hide anything from them. Because they can track your currnet situation today or in future if required. So provide them all real things. You can call call centre ppl at 1 888 242-2100 to discuss the matter. Dont worry, it wont affect yor file as yo are not disclosing your identity. AND YES Undergo Med Exam and send results to Ottawa as a routine procedure. And if they have asked you to submit documents whatsoever so, submit them.

Your skilled worker immigration application will NOT be rejected because you are unemployed at present.

Just tell them the truth and send all the information you have. You can write a letter explaining your current situation.

I am living in US right now and I am a US citizen. The reason why I want to come to Canada to be with my boyfirned and I wantr to work there. I was there during the holidays. I did my medical in Canada and the doctor sent it, I also opened a Canadaian Bank account and deposited about $10000 US. As well I am applying for all these Canadian jobs but most employers do not look at me seriously when they hear that I am still in US and I can not work till I get my visa. While in Toronto, I was called for an interview and once I told them I am waiting for a visa, they employer went cold on me.So you think I should send what I have and hope and pray?

This is so confusing, as I was writing this, I got a call from my BF in Toronto where he tslk to this imm lawyer who said that the application might get rejected. The lawyer has told him that we need to pay him about $300 so he can write a "SUBMISSION" - I am not sure what is a submission - and hope for the best. He also said that if the application is rejected then he wants about $3000 to appeal it...Can you guys who has real life expience, help us on this

The lawyer is right. They will reject your application if they find out you are out of work. If employment was not so critical, they would not have asked you to send all those doc (Paystubs, W2 etc) after your AOR. So good luck!

the laywer wants more and more money. that´s it. your application will not be rejected because you don´t have a job. you get points for work experience, not current employment.
the lawyer might just trick you saying that the application was rejected, he appealed it and you won. in fact nothing happen and you just payed 3000 for nothing.
If I were you I would just send a letter to Buffalo asking them to send all the future corespondence to the address you reside at.

AH, you will not be rejected for PR for not being employed. I know many people that apply for PR in Canada while they are doing their master´s. They use their previous work experience to apply. Your lawyer is just taking you for a ride. DO NOT give him any money for any submission letter. You only need 1 year of work experience to get your PR. The fact that you got your medical forms means that you have pretty much passed, so as long as you are not a criminal and pass your medical you will get your PR within a year. If I were you, I would drop this lawyer immediately!! Just handle everything on your own. All you need is your file number and all the letter CIC sent you.

Another thing, the reason they asked only for your 2000 to 2004 W2s is because they can only count a maximum of 4 years of work experience, so the fact that you were fired in Aug 2005 is not going to be considered.

I´ve also asked this question of this forum. I think Joy is probably right - that CIC is not interested in whether you´re employed at this moment in your particular skill.

But then I wonder why all successful applicants keep reporting back to this forum that either at the interview or my mail, CIC wants a "Verification of Current Employment" from the applicant´s employer? This is the troubling concern.

dont trust the lawyer...he is talking BS

you should be fine ..just do the medicals and consider the options told by other people here..
ideally you just need one year experience in the last ten years in the field that u are applying ,,
as long as u have more than 67 points,,,u are fine ....
