Subject: Similar prob re fiance staying in canada
  I have a similar problem. My fiance applied as a skilled worker as at the time we hadnt been living together for a year. Now we have, however she still doesnt have her PR card. I asked a lawyer about amending my application or reapplying under the family class, as I know sponsorship applications seem to be dealt with quicker. She advises that as my fiance has overstayed, I cant sponsor her. I could only sponsor her if she had kept her legal visitor´s status. She is also appealing the extension of her visitors status..

Any advise? Thanks.

Why on earth should people who overstay visas in Canada (or any country) be allowed to stay here while they wait for a Skilled Worker or Family Class application??? There is no excuse for not reading the rules or calling CIC for instructions if you are not sure. People like myself have jumped through hoops for Immigration Canada to abide by their rules so as not to jeapodise my Permanent Residency application.

Why do people put themselves in a situation in which they have illegal status in Canada and think it won´t negatively affect their PR applications? I have no sympathy for you and am angry that your PR applications clog up the system which should give priority to law abiding applicants.

Without knowing the details of this guy Liam´s case, and knowing the reason why his fiance hasnt kept her status, I think you´re being pretty harsh.

We all make mistakes. Give the guy a break! With respect, you´re entitled to your opinion, but I thought this forum was to help people. I´m sure the guy feels bad anough and knows he has screwed up.

Liam - good luck with your application. Maybe your situation could have been avoided however, now you´re in it, there´s no point listening to comments like that of Amanda´s. Maybe your case would be useful to someone else to help them avoid being in your situation.

Lets try to be constructive - not destructive.
