Subject: Unemployed after applied as SW from US
This is a follow up on my pervoius posing. A lot of you guys (Thank you) said that being unemployed will not effect my application (Though a lawyer in Canada said otherwise), my question is then why CIC is asking for W2, paystubs etc at this stage of the game (After AOR and IA)?? Anyone, please

If you had 4 or more years of working experience (within the past 10 years) then technically you should be awarded the max points whether you are currently employed or not. I don´t know of any provision that said an applicant needs to be currently employed.

Sadly, our cases are being reviewed by an individual and not by a machine. So it means it is based on the individual´s assessment. One officer may interpret unemployment as a negative factor in your adaptability and one officer may not give weight to it at all.

They are asking updated W2s because they want to get updated information from you. If you don´t have then I suggest submit a letter explaining the matter instead. Always sound polite and courteous in all your communciations...remember they are reviewing your case. :)

I believe every rejection is appealable (not sure though)...but I don´t think unemployment can cause rejection specially if despite this you still met the required 67 points......and besides what choices have you got? can you tell CIC...´no I do not like to supply you with my current W2 and I am not explaining either´...I understand your concern trust me...I was unemployed when I applied and my next employment was different from my previous skills, they didn´t seem to mind...you might be worrying about nothing...I would advise you to be honest and if you are a man of faith...lift it up to God...He knows the desires of your heart...good luck :)

Thanks Joe05. Sometimes I wonder why do we need lawyers. Evey time I talk to one, it makes things more complicated. I am just worried, just cuz I am a girl and that´s what we do :) worry. I am waiting for my W2 for this year and once I get it, I will send everything which I got. Do you know how long (if everythig goes well) would it take for me to get my PR? Is it another long wait?

AH, you honestly should listen to people who have gone through this process before. I can´t believe that you´ll still stay with a lawyer that would lie to you like that and try to cheat you out of your money. Being in Canada doesn´t mean he´s honest. Actually, there have been several stories here in the news about umlawful immigrant lawyers that take advantage of naive immigrants in similar cases. So beware. There are many people who are going through this application process without a lawyer, and they seem to be still getting their PRs. Usually after your IA, it takes from 8 to 12 months for you to get your PPR. Hope this helps. Don´t worry about anything. I´m sure everything will work out for you.

Did you apply in Buffalo? Have you done medicals? Interview is waived?

If yes to all...then you are just waiting for the background check to be done. This can be finished from 3 months to well over a year depending on which countries you´ve lived in the past...depending on the cooperation from your offices...schools...etc. To reduce frustration about waiting time, let´s just assume it´s another long wait...maybe a year?!...here´s hoping it would be faster for you...good luck.

I have always lived in US and yes the application was sent to Buffalo. The interview was waived as well. I have sent all the police certificate, just did the medical and waiting to get my 2005 W2 to send it to CIC. I have also opened a Canadian bank account and deposited about US $10,000.00 and I am planning to send this information to CIC along with my W2 forms. I am hoping to get my PR as soon as possible so I can start my new life in Canada with my BF....

Sorry guys, what is the next step from here? Getting another letter from CIC, getting more instructions? I am not sure. So being this far in the game, should I not worry about rejection? I have also paid my Fee for landing with my application.

the only cause for rejection at this point is if during the background check, something untruthful will emerge in school records, work records or unfavorable medical results or anything questionable about security matters....otherwise, looks like your just waiting for your passport request.
