Subject: Went and fell in love with a Canadian..
  so yeah, the title says it all, we are engaged to be married but have not married yet, I am a US Citizen she is a citizen of Canada, I would like to immigrate and become a PR but for now.. i´m just looking for work, I am 20 I have 7 years experience in retail sales and 5 years experience in shipping and recieving for the same company, I don´t believe either of those would fall under skilled worker in any way but i´m not positive, I could be missing something. My question here is I am for start going to apply for a work permit to work while I get my immigration figured out, I know you can not just apply at wal mart and expect them to approve your work permit so what I am wondering is if there is a field of work in Alberta that anyone can recommend I apply for that the HRSDC wont have an issue with approving, I am willing to do just about any type of work I have the equivelent of a high school diploma (GED or also known as good enough diploma!) but no further schooling, I have thought about the oil field however I would prefer not to have to do that but will if it comes down to it. Also if my fiancee and I were to get married before I applied for immigration I have been told they may see it as a marriage of convience, although it is certainly not that I am curious what you need to prove that your marriage is not that of convience, and since the only two types of "skills" I have experience with would be retail and shipping, I suppose family class would be the way to go, however what if my fiancee could not support me or even come close to showing that she could? other options? recommend getting an immigration lawyer? thanks for the help in advance

I guess since you do not have any further education or experience you cannot apply for immigration as a skilled worker no way ... I personally do not think you can get those points so the only option will be your fiancee, she can go back to her country together with you, marry there and she can show her job, and income if that is enough to support you then please check the CIC site ..

I think the title of your thread is one of the best I have read here in about 18 months! Yes, we Canadians are very irresistable. :)

Family class is your only option. she does not need to prove income to sponsor you. instead you must prove the genuine nature of your relationship. the best way to do that is to marry. You could possibly attemt a common law or conjugal sponsorship but that might be more difficult.

have a look at the CIC website for all the requirements. It is a lot of paper - but it is doable.

There are no income requirements for spousal class.

We recently looked into work permits, and for one, you need a valid job offer to even start. In order to get an HRDC approval the company has to prove that it could not find a Canadian to fill the job. That would be a stretch for a retail or shipping/receiving position.

A spousal application would be the way to go, IF you´re both seriously ready for marriage. Marriages of convenience are those who marry solely for the purpose of immigration, and applicants from countries/cultures where arranged marriages and substandard living conditions exist are questioned on this more. Not so much an issue for Americans.

You have 3 options under the family class; Common-law, where you need to have cohabitated for a minimum of 1 year, Conjugal Partner - unless you have a VERY good reason why you LEGALLY cannot get married, forget about it, and Spousal.

Once you´re married, you can file either inland, or out-of-canada. Inland applications are processed through Vegreville, Alberta, and that allows you to remain in Canada with your spouse while your application is processing... which, incidentally takes FOREVER. Until you get AIP (approval in principal), which is currently taking up to 8 months, you can´t work. There are also no appeal rights in this class. If you´re refused for whatever reason, you will need to return to the US. The only benefit to this option is you get to be with your spouse.

The other option would be to apply out-of-Canada. Both the sponsor and applicant applications go together to Mississauga, and once your spouse is approved to sponsor, your portion is sent to a Consulate in your country (in your case, likely Buffalo) for further processing. This class processes within 6 months, usually. Of course, you are still free to visit your spouse while your application is processing, and as an American you may visit for up to 6 months. If your application is refused, for whatever reason, your wife (as a Canadian) would have appeal rights.

If you´re going to go the Spousal route, start collecting stuff and putting it away for safe keeping. Lots of photos, together, with family, friends, wedding photos. Phone bills, flight/travel receipts. Combine as much personal stuff as humanly possible. Joint bank accounts, credit cards, loans, beneficiaries on insurance policies, RRSP´s, 401K´s, etc. Anything to prove your relationship is genuine and with permanence.

thanks very much for your replys, it has put me more at ease and I have found a bit of relief in what you have wrote that this just might not as hard as I had thought it would be (because I thought it just might be impossible) I talked it over with my fiance and we are going to apply for the out of canada, sounds like a much safer way to go and not all that difficult to go through.
