Hi guys,
I just need a piece of info.....what are the chances that if one´s application is rejected to go for an appeal? Is it possible and within what time frame we should go for appeal......another thing suppose u r rejected and u want to apply again, then how long after the rejection can one apply.......any inputs highly appreciated.

An appeal can take up to 2 years, and will cost a lot of money. Depending on the class in which you filed, it may be easier to reapply. You are free to reapply as often as you like, but if the reason(s) for which you were refused were not resolved in subsequent applications, chances are you´ll be refused again.

hey buds same thing happened to me also..
but i did´nt appeal i just apply from fresh but the thing is if you have something additional to what you submit before the only submit..nor wasting time nd $$$$

HI, THANKS YOU FOR THAT TOPIC, I AM FACING THE SAME ISSUE RIGHT NOW, I JUST RECEIVE TWO DAYS AGO MY APPLICATION WAS REJECTED.

Hi my Skilled worker class Visa was rejected based on the points. I was minus 2 points to requirement. Now have filed a case. Does the court always uphold the decision given by visa office or do they give another fair chance of going through the process again ? any one have any experiences ?

Hey lucky-unlucky
i was told by my lawyer that the window for appeal is 60 days from the date of rejection. First you need obtain leave to proceed with the case from Federal court. If they see that my application has been evaluated unjustfully, they will assign it to be re evaluated again by another visa officer. however there is no gurantee that the decision will be changed.
In my case I was minus 2 marks for the requirement and now I am doing IELTS again to get that 2 marks up. So if they decide to evaluate again, hopefully I would be able to present the new marks.
