My partner will have been here in Canada from the Philippines for 11 months on a Temp Res Visa(as of Feb 28th when her present visa with extensions runs out). We have lived together for that time (her drivers license same address, bank account etc.,mail address). What we tried to do was go to Canadian Consulate General in Buffalo and apply for a temp resident visa multiple entry before her present extension of stay expired so she could return home for compassionate reasons(the loss of an aunt, educational arrangements for her children)for a short visit 2-3 weeks and then come back and then we would apply for conjugal sponsorship landed immigrant status application Because she had a valid single entry temp visa Consulate General in Buffalo said for her to apply back in the Philippines.
PS:Another extension of her single entry temp visa would not allow her to return, thats why we wanted the multiple entry visa from Consulate General in Buffalo as it had to be applied outside of Canada.
other information: our relationship started in September of 2004( phone and mail) until we raised the money for her to get here. I(her partner and sponsor) am separated since july of 04.
Question: Do we qualify for common law even though she had gone home only for a short stay or do we have to apply as conjugal?
Question: Is it easier to apply for landed immigrant status conjugal/common law sponsorship while she´s in Canada or back in the Philippines?
Question:Is the medical(jan 2006) that she just had for the temp resident visa valid for her landed immigrant status application.?
Please any advice or direction would be of great help.
