Subject: Resident after working in Can. for 2 years...
  I have a friend who came from Brazil on a student visa. She has been extending the visa and working here in Canada for two years now and is interested in applying for permanent residence.

She has been working in the food service industry as a waitress and her English is excellent considering she could hardly speak a word two years ago! Everything has been above board.

Can she return to Brazil while her application is processed? She hasn´t been home for two years and wants to visit her family. Can she apply while she´s here and visit her home country?

Regardless, she will return when her visa is up (6 weeks from now) and wants to stay in Brazil for 3 months and then return. What are her chances of getting another visa?

probably not very good. reason being is that CIC will see her full intent to make Canada home. Should she not be accepted as a skilled worker, but be wanting to reside in Canada during that time... there is huge administrative concerns about her leaving the country on her own accord.

I would not risk it. Once she is out... it might be tough to get back in.

What about a visitor´s visa (ie. TRV) for 6 months?

How long should she stay in Brazil to convince CIC that she wants to give Canada another try? Is there a set time frame?

Is it her study permit that is expiring? If she is finishing school then she is allowed to get a post-graduate work permit for a maximum of 1 or 2 years. She has 90 days from the last day of her exams to find a job and then apply for her work permit. Before she can apply for permanent residency (PR) she must have a minimum 1 year work experience that falls into an accepted NOC code. Look at the skilled workers page on the CIC website and find out if she qualifies. The best way for get to remain in Canada is to get a post-graduate work permit.

No way would she be given a visitor´s visa. She´s been here too long. I´d say give it quite a while before returning... like, 6 months to a year.
