Hello everyone,
I wonder if you can share your experience in this complicated circumstances. I have a friend who is a Canadian PR, soon she will be a ciitizen. She is in contact online with someone who has been illegal in USA (overstaying). They both want to get married and then she can sponsor him. Some of the threads in this forum suggest that the illegal status either in Canada or USA will not allow the legal marriage to take place. This can NOT be true. Trying to help as I can I have been searching around and attending too many different forums but could not reach a clear cut conclusion of the best advice. However, I personally know a very similar case. I will tell you briefly about it. Please concentrate your opinion on this case, I
know about, because I would be able to make a concrete advice to my
friend based on this real life case.
I know a PR who was in contact with someone who had been illegal in USA. They decided to get married. Whether they were in true love or not, this is up to them and is not my trouble. But beyond any doubt, the man who was illegal in US was obviously looking for papers. The man suddenly appeared in Canada. They got married legally and also she got pregnant from him. There is an immigration issue for them but I do not know details nor do I know what kind of immigration matter (sponsorship or whatever...)
Having read all about immigration processing and visas, this man could not obtain any Canadian visitor visa from USA for the reason being illegal there. He would not have a sponsorship done successfully in one or two months even he was legal in US, specially he is from those countries which require an extensive background and security check.
The question is : how did he get married in Canada if it is madatory for him to be legal in USA or Canada in order to get married?
if what I read here is true that illegals can not proceed for marriage? How did he come to Canada? would the marriage and the child save his intention to get PR in Canada? I am also doubting if he had a refugee claim because he was in USA for years and has no ground or reason to be a refugee in Canada? Would the refugee claimant just pass the border, claim the refugee status and enter the country to get married or do whatever he wish in a week or two?
I know it may not be one of my business but it is 100% true life story. I am only trying to make a good concrete advice to my close friend in this critical stage of her life. I would like to make a good balance between her heart and real life. As I may take the bravery lead and advice her to barry her love and heart forever.

(in reply to: Want advice please on family sponsorshp) Hey Linda your friend must be so lucky that she has got a very nice friend who knows everything in details about ´that friend´ and who is trying hard for ´that friend´ .
Some questions:
1. How is somebody living illegaly in a country will legally married ? Seems weird to me...
2. Lets say they get married, when that person in Canada sponsor her, Isnt CIC going to ask for police clerance from his wife or FBi check or etc from the country she is living in at the moment (which is USA and she is living there illegally)? How is she going to provide such things from a country where she is living illegal ?
3. Do you really believe that you friend fell in love with somebody especially when her situation became illegal in USA ?
4. My personal opinion, she should a. either try to change her situation in USA and make it legal, or go back to her own country and then the other person from Canada can sponsor her...
5. However, I do not want to make you feel sad but if I were an officer in CIC the moment I hear that she is living in USA illegally and at that time she gets married to somebody in Canada will make me think ...mmm is this a fake marriage ? or a set up .... ??
Well just my own opinion... that doesnt mean whatever I say is true!...

I think you misunderstood the post. My friend is PR and will be a Canadian Citizen in 15 days. Yes she loves this person in USA. He became illegal after overstaying there..I know this.
But we were talking about the other real (but similar)case. This man in the real case is already married and staying in Canada. He came to Canada after being illegal in USA. He got married to his lady who was PR as well that time and now she is a Canadian citizen. I do not know how did he arrive to Canada?. But, he got married in Canada anyway. That is to say being illegal does not stop anyone getting married. Also, I know for sure, that being illegal in USA does not stop anyone to get FBI clearence as long as no criminal record is there. It may have a negative impact on the case itself when processing starts and the history is showing the illegality in US.
So plz try again read the original post: and guess with me how did it happen. I am just trying to get the friend to accept the reality.
I would be interested to hear from you plz and others.
