Subject: Married to a Canadian Permant Resident.
  Hi all

Im married to a canadian permanent resident card holder.. We planning to move to canada within the next few month..

I am European meaning I need no visa to visit canada. However moving there I would need to work to help maintain the family. I have already been offered a job with a European Company but they have already used their "quota" for working visas.

How do we approach the Canadian immigration laws? Does she have to sponsor me now that we are already married? Does it help that I can present a contract from a company willing to hire me??

Hope someone can help

Hello,

If you start with sponsorship process from "IN CANDA", you would not be allowed to work till the time you get your AIP (Approved in Principles) which can take up to 7-9 months. If you start from (OUT of CANADA), this may hinder your job opportunity with this company. You may not even be allowed to enter Canada till the final outcome of sponsorship process even though you are European and you do not need visa to visit. However, the out of Canada applications are faster, but no guarantee as every case is individual.

If I were you I would take the company job first as long as they can help you to get the work visa soon. From there, your wife can start sponsorship application from IN CANADA. So, you can get benefit of both. It may even add to your credit during the immigration processing.
I am not sure if anyone else has had this experience here, in order advise you further.

Good luck.

From what the OP said, he`s just got a job offer with a random-ish company. The job has to be endorsed by the Human Resources Dept. of Canada which means they have to prove the OP can do the job and no Canadian can take his place, e.g. the OP has to be skilled in a way no Canadian is or have a special qualification. A lot of these jobs are denied by HRSDC because they are not specific to the wannabe employee. So, the OP would need to get the job assessed and might then be offered it if there are no Canadians around.

If the job isn`t endorsed then you can use the offer to add to your skilled worker application but that would take 3 or so years to complete. Best route is in or out of Canada sponsored spouse (go to CIC`s website!) and if you want to come in the meantime, see if you are eligible for BUNAC or similar.

Hi
That is exactly what I meant. I thought the company will proceed and get him the approval of the HRSDC. However, the job and HRSDC is, and should be secondary to his sponsorship family application.
