Subject: need help with canada interview
  Hi my name is Terri and this is the first time posting. I am with my partner of almost 4 years. She is from the UK and I am from Montreal. We have been communicating on line since 2002 and we did not keep any of our conversations from MSN or Yahoo. But we have visited each other and we do have proof of that. Last year in July 2005 Karen came to Montreal with her son of 9 (at the time)for a visit. We applied for an extension well before the six months was up in January 2006. As a matter of fact we applied for an extension in November 2005 and finally got an answer January 9 2006 that the application was being sent for processing to an office in Montreal. On Thursday February 23 2006 we got a letter for both Karen and her son telling us that we must go for an interview. The reason we are applying for an extension is because we are both females & we have to live together for 1 year before we can apply for PR and the only way we could do it was to visit for 6 months and extend for another 6 months so we can apply from Quebec. We have decided to get married in April 2006. Karen is 49 years old and I am 53 years old and we do want to live together as a family. Karen also has previous convictions(which they have)but have not been in trouble with the law since 1989. I am legal guardian for her son and he is attending an English school in Montreal and also learning French. Being in the province of Quebec we needed a certificate of elegibility which we recieved and expires in 2007 and we have applied for an extension until 2007. Being visitors we have had to pay almost 5,000.00 for her son to attend public school. What we want to know is, should we tell the immigration people the truth that we plan to get married and apply for PR or should we try to avoid it and get married and then apply for PR? We are both concerned about the interview and need some answers. Also do they have the right to question her son who is now 10 years old? What kind of questions can they ask her seeing that she is a visitor and can´t work. Just to let you know that she does have money to support herself and her son as she sold her house in the UK. This may not be much help but I would try and trawl up any old letters, e-mails christmas cards etc to try and prove the time frame of your relationship. As to the question of mariage - could you not just go under the conjugal partner route ? I thought the main reason for this was to help same sex couples etc who could not meet living with each other for 1 year due to immigration barriers etc.
I see no reason why not to marry in your own timeframe - it may be a long haul considering your partner has a child and the difficulties that may arise should her previous partner in the UK not approve - this would be ok if the child was IVF.
As for past convictions - depending on what they were and if any custodial sentences were imposed they will only have a certain life after which your partner could apply to the home office to have them removed i.e. spent convictions. I hope what little I could put here helps - an immigration lawyer is probably th best bet tho

Hey Terri,

a. No need for the lawyer do not spend your money, you have a brain and rely on that,
b. Try to provide all the pictures, letters, any other gifts you have had from each other which could be shown,
c.Be honest with the officals in CIC, in fact sending your partner´s son is a very good sign of your relationship that it is true and genuine,, do not hide it from officals,
d. From my knowledge since your partner is from a developed country, there is really nothing to worry about if she has a very clean background,
e. No officals can question any person who is 10 years old, that is against human rights, there is her mum to answer questions on behalf of him,
f. Just be alert that the child of your partner´s has been in montreal and living there and intends to live there and She- your partner - has got a consent paper from the father of the child... Be careful about it, the officals´ main concern will be ´ whether the father of the child has given his mom to take the child away and lets him leave there´
g. If you are financially ok belive there will be no other problems just feel safe...

Hi everyone, thank you very much for the speedy reply. As we are both very nervous about this interview. And its only for an extension. My question is our wedding is already planned for April and my partner has the interview with immigration March 8 should we tell them that we are getting married and going to apply for PR. Also my partner has sole custody of her son by the courts in the UK. And she has a letter from the father stating that his son can leave the country (which he has already left and is here for the past 7 months.)Again thanks a million to the people who answered us. I will give you more news as it comes.

Telling them that you have a planned marriage, and being open and honest in your reply will pay back as a positive reply...

Considering all the points you have mentioned above, I am sure you will get whatever you ask for and the interview will not take more then 10 minutes...

By the way expecting you to post here on March, 8th, telling us the good news..
