Subject: in-canada spouse sponsorship

Hello!

I´m Canadian (residing in Quebec) and my spouse is Spanish. He lives with me under a visitor´s visa (renewed with no problem twice) which is valid through September 2006.

We are married (Quebec) and we sent the sponsorship/permanent residence forms under the ´in-canada spouse sponsorship´ case type in august.

This is our case history from the online site:

------
We received your application for permanent residence on August 08, 2005.

We started processing your application on September 20, 2005.

We sent you a letter on March 02, 2006 to (XXX) about approval in principle for you to become a Permanent Resident of Canada. If this address is not correct, please contact us. Thank you.

----

Here´s the question -- what´s the next step and how long is it likely to take? In the letter we received in the mail it mentions something about CIC going on to check medical results, security checks, police certificates - however we did the medical exam and included the receipt upon sending the forms in july/august 2005... will he need to take another exam?

It also mentions that he can now ask for a student permit / work permit from Canada -- is this worthwhile or is the permanent residence likely to arrive within the same timefram as these permits?

Thanks!!

your spouse should go ahead and apply for an open work permit. it takes 27 days (according to yesterday update). the PR can come anytime between 4-12 months, depending on the background and security checks.

Hello!

Thanks for your answer mircea!

4-12 months? Wow that´s quite a bit longer that I was hoping for.. Would obtaining an open work permit facilitate re-entry to Canada if we go spend a couple of weeks in Spain this summer or would it be unadvisable to leave the Country for him until all the PR stuff is complete? Or would he still be coming in as a visitor and therefore have some possibility of being rejected at the border?

thanks!

Hey,

I´m English, living in Montreal, applied for PR in Jan 05 (partner is from here). Got approval in principle in October and am still waiting... the worst thing is that no-one can enquire about my case (not even MP, been there, tried that) because the security check from Canadian Intelligence is pending. I´ve been told not to ask until the case has been open for a total of 18 months (!). Apparently if you don´t leave Canada (as you´re not supposed to) the medicals don´t ´expire´ and it´s highly unlikely we´ll have to do them again (mine expired Jan 06).

So I would strongly advise 2 things:

1) YES get an open work permit, if your partner wants to work asap or if you need the money. It could take a LONG time to finalise the paperwork

2) DON´T go to Spain in the summer or you will invalidate the process. An open work permit won´t permit reentry and you can´t get one that will. (I missed my father´s 60th b-day for that)

It´s really tough so good luck.

Hi, I´m living in Calgary, I married a Permanent Resident and have applied for my permanent residency 6 weeks ago.
Inside the envelope I sent an open work permit application as well. I haven´t heard from CIC at all, they didn´t even confirm that they´ve started processing my case.
I know they got my envelope because I tracked it on the canada post web site and there´s a confirmation they received it.
Is this normal? and do you have any idea how long it will take for me to receive the open work permit? I need to work!!!

thanks
Silvana

He should of applied before you came to Canada or with you. If he is here go to www.cic.gc.ca and look for forms In Canada then worker and change his Visitor Record to a Work Permit.

Travel (in reply to: in-canada spouse sponsorship)
We applied for my Permanent Residency for Canada in June 2011, as an inland application. I have a green card from the USA. I need to travel back to my country, does having that green card will allow me to enter back into Canada? Does traveling with my Canadian husband and children will help me at the border together back in? Is there any advise about how to do this? Any help is highly appreciated!
