Subject: Re-Instating Residency
I first came to Canada in 1983 and was granted permanent residency, I had a Canadian husband at the time and have 2 Canadian kids, early 20´s. I was forced to return to UK in 1988 by my husband and shortly thereafter separated, he then returned to Ottawa 6yrs later and now my kids are both here. I´ve come over for 6 months on a visitors visa to be with my daughter who is in ill health and needs my support, my partner and I want to stay for up to 2 yrs and need work permits. My Q´s are
1. Does anyone know if my status would still be valid - if not could it be re-instated.
2. Can you get a work permit without a job offer in order to look for work. How long would this process take applying from within Canada.

I have emailed Immigration several times and they keep directing me to their website, which doesn´t help and in Ottawa you cannot call in on them as I cannot find an address for an office.
I would appreciate any information someone may have.

Many thanks
Les

No you can´t get it re-instated. You would need to re-apply or have one of your Canadian children sponsor you for Permanent residence which takes about 2 years.

I was a resident and left Canada in 2000 and didn´t return. I got remarried to a Canadian last year and when we decided to live in Canada I had to re-apply for permanent residence. My wife in Canadian and that didn´t make any difference as I was out of Canada for too long. Back in 1988 if you spent more then 6 months out of Canada they classed that as abandoning Canada and you lost your status. They changed the residence act in 2002 so now you have to be present in Canada for 2 years in a 5 year period to maintain your status.

Thanks Pete, I had thought as much but just wasn´t too sure. Maybe I´ll try and talk kids in to coming back with me instead.....

Or you could apply as a skilled worker. The wait time is 4 years but in the long run it might be worth it if, say, your daughter´s health deteriorates in the distant future. Might be worth a shot, you´re not giving up everything for it, just do the paperwork and see how your situation is in 4 years!

Sponsoring parents will take more than two years and must meet Low Income Cut-off.

anonymous, did you even read Omoding´s request before you answered it?

Omoding, I am afraid this forum is only to discuss immigration issues. Information about Financial assistance is something we have no expertise in. Are your children in Canada, Uganda, where? How does anyone know that your story is legitimate? There are groups such as World Vision, or UNICEF that may be better organizations to approach.

good luck to you.

"You would need to re-apply or have one of your Canadian children sponsor you for Permanent residence which takes about 2 years." - Sharon should read above post before taking anon. to task. Anon. is responding to Pete, not Om and it´s true, sponsoring parent does take more than two years.

Pete´s post is from 2006!!!! why would you answer a post that is 3.5 years old. I highly doubt that Pete is still waiting for an answer.

For heavens sake this is blown out of proportion. Mine is the original post. I´ve been happily living in Canada for 3 yrs. How can I delete the original?
