Subject: Cancellation of Representative
  Dear visitors,

I want to cancel the reprecentation of my lawyer and would like to know how? Now he receives all the e-mails from CIC and I want these letters come to me directly and not to him. Do I have to pay him to cancel (or this is blackmail) or I can do it myself and then receive letters from CIC directly to me?? Please heeeelp me.

you have agreed to pay your lawyer $xxxxx for certain services. In your contract there should be information about cancellation and refunds. You can change the mailing address by formally contacting CIC by mail, using your file number. Chances are good your lawyer has held back your file number to insure payment. If he has not be negligent - he is entitled to be paid and will not turn over the file information until they have been paid out.

is that blackmail - not really. it is contractual law. If they have been negligent - you might be able to negotiate, but be ready to make your case.

Thanks for the reply, though sounds complicated!! I just needed to know how to be representing myself and receive e-mails directly from CIC, not from lawyer. I have the file number and use the e-client service but I need to know that my case is updated and letters reach me directly. My lawyer is careless and I want to decide to cancel his representation. What are the formal steps? Can I do this or I have to pay him to do it instead of me? Thanks for any more info from all.

Sorry,,, one more thing.. nothing is mentioned about cancellation of representation in the contract...

all you have to do is call CIC and update your mailing address and let them know not to provide any more info to your lawyer .

and then you should see your updated mailing address in eclient within a couple of days..

they will also ask you to fill out the appropriate form and fax cic to cancel your lawyer´s representation.

that is all .. nothing complicated

Hiya Lebanese Woman,
1.In order to give you some legal advice we have to see what is there in your contract item by item otherwise whatever we say will be out of blue..
2. In general lawyers are clever people most probably there is an item in your contract "if the parties .... " there must be a legal responsibility for you, (lawyers always consider the fact that their clients can cancel their contractsany time therefore legally they protect themselves.
3. You can legally cancel your contract any time but that means you agree to pay any outcome..

My suggestion: Talk about your intention to your lawyer politely (for example tell him that you will go to another country or city to live and work so it will be difficult to communicate etc. )) and lets see what he will say ...If he says you will have to pay some amount of money, think about it, negotiate with him and try to get an agreement between... If he insists that you should pay a lot of money back to him to cancel your contract, then see another lawyer, together with him go over the items in your contract and ask for your legal rights- what you can or should do ...Those people who can give you legal advice must be the lawyers in your own country or the place of the contract- agreement.. because there are times that law for sure might change from country to country ...

If you are really decided on this, here´s what you can do to inform CIC:

1. Fill up this form:

http://www.cic.gc.ca/english/pdf/kits/forms/IMM5476E.PDF

2. Make a cover letter about the cancellation and also about your new mailing address and other contact info like email add; phone etc. Make sure to put your file number on your cover letter. You don´t have to give reason for the cancellation.

Thank you again and again. I will follow the instructions and wish the lawyer will not do me any harm like cancelling my case as a reaction to cancelation of his representation. Can he do this? I am afraid he uses my authorization to him to contact CIC and cancel my file or case!! I ended things with him but afraid he will do this behind me and later on I can not do anything in the future when I discover he cancelled my file or case in CIC. Thanks for valuable comments dear friends.
