| Subject: Inland spousal with child dependant question |

I would like to know if my inland spousal application would be very complicated and possible refused based on the following facts.
I am Canadian citizen and resident. My fiancee is curently an Australian resident and citizen, officially divorced and has been court granted full custody of her child. We plan to marry in Canada (where i live, quebec) and then apply for inland spousal. I would also sponsor her son. I have been with her for almost 2 years and have proof of so, through pictures, mail, travel documents, even rental lease (partial living in australia with her last year).

Might get sticky regarding any visiting rights etc the father might have especially seeing as your fiancee and her child would be making a big step by going to live in Canada - not like it´s just down the road. I think you would have to get her to obtain the court to grant an order releasing the child out of the courts jurisdiction - i am not too sure how easy that would be.
As for getting married you would be making a good move as conjugal is a bit iffy. then again I am not too sure of the stipulations they have in Quebec

The father is a non Australian citizen or resident, residing in Europe. He has no contact with the child and not paying any child support. Aside from Australian court granting full custody to my fiancee they have even granted permission to apply for passport without fathers consent due to the above circumstances. So basically as you see, he is out of the picture.
This is a maor concern to me, since it can affect many things.
