Subject: Urgent : Please answer this two questiones
  I have heared if some one wants to marry after he received his immigration visa, he should first land,wait until the PR card is received, then return to his own home country, marry and then return to canada . Now he should sponser and apply for his spouse while in canada.

I have two questiones with this regard:

1- By law, in my country it is possible to marry some one while she is far. Just an autherisation from him/her is enough.
To save flight cost and prevent unnecessary rush, I can achieve her authorisation and marry in our embassy in Ottawa, then sponsor and apply for her. I would return to home every time I could to have the ceremoney.
I wonder is this a lawfull marriage in the CIC terms ? Can I apply for her in this way?
2- Could you please interpret this:" you should be physicaly in canada when sponsoring your spouse".
I understand that it means when you post your application , you should be in canada.
But what for after ? can you leave canada for let say six months until your spouse visa becomes ready and then fly to Canada together?

Yes Al, I think it should be acceptable as long as you do NOT confuse the CIC Officials with your plans. Just be simple and work your plan out. Its fine.

Hi Al,

1) To sponsor your wife you need to provide conclusive proof that the marriage is legitimate. Along with the marriage certificate you need photographs and proof that the marriage actually took place. It is my opinion that the way you are describing the marriage it may create doubts in the mind of the immigration officer and s/he may call you for an interview and that will just increase the overall processing time.

2) I believe that the applicant has to be present in Canada throughout the process.

I strongly suggest that you consult a lawyer and get professional advice.

CIC office might object to your relocating so soon. You have just emigrated to Canada and are sponsoring someone else without an established ties (work or living) in Canada.

Whereas legally you are in your rights to sponsor your (to be wife); you must have a duty towards your newely accepted country of residence. This is not a tourist visa - unless you have your own business you ought to be establishing your self and show it to CIC for your case of sponsorship.

In anycase that is your personal business - the officer has his right to ask you this intent you wish to carry. Better as suggested consult a lawyer to ensure a smooth application.
