Subject: I think I might be okay, but you tell....
  I have a question....
Say I get my Passport stamped with visa this year in Sept and CIC wants me to land before Nov. But we are expecting a child in Nov, then what is procedure we need to follow so that we do not get into any problem situation as far as the PR for my child ?

I live in US, and I plan to come back to US immediately after we land in Canada. Also are we allowed to land in the ending months of pregnancy ?

If the kid is born after we land and come back to US, is that okay and we can just apply for his/her PR as a dependent ?

Any experiences are appreciated.

I would land before child birth and have delivery in Canada. Then child automatically can become a canadian resident (right of birth on the canadian land). After applying for his status inside Canada child will recieve residency. But if you don´t plan to pay for delivery the spouse should be there at least 3 months before to apply for province insurance. Otherwise she will need to buy insuarance or pay for medical service.

Olga is right... if the child is born outside of Canada, the only way the child would be a canadian citizen is if either you or your wife is a Canadian Citizen, as the child would receive automatic Canadian Citizenship through the parent (regardless of what country the child is born in).

However, if you or your wife is not a Canadian Citizen, and the child is born outside Canada, you will need to sponsor the child for PR once you are in Canada.

In my situation, I don´t think we can be in Canada for the delivery.
Cheri, you mentioned abt sponsoring the kid for PR, but I am counfused abt the "once you are in Canada" part.... Do you mean that even though the kid is not a Canadian citizen or PR, we can still carry the kid to Canada when we move later and then apply for PR ? I am thinking more like, after we come back and have the kid, we will have to apply for his PR "outside" Canada and he can come with us only if his PR is approved right ?
Please advice.

No.. you cannot enter Canada with the child. I have heard of cases of landing with a newborn baby that was not included in the application.. the officer refused to let him enter canada and told him to reapply for the child.

Since neither you nor your wife is a Canadian Citizen, after your baby is born, you will need to add the child to your application.

Inform the Canadian consulate about the baby and request then to add your her/him to your PR application. Send the following documents:

1) Certified copy of baby?s Birth Certificate
2) Copy of Passport
3) the second page of IMM0008
4) application fee
5) 4 photos
6) Cover letter to inform CIC the birth of child (make sure to include your file number).
7) Additional Family information (IMM 5406) form

Form IMM0008 - only page 2 must be completed by the principal applicant to show details of newly added dependant.

The baby´s medical will also need to be done.

CIC will inform you of any other information you need.

Hi Raj!
May be you still have an option to bring child to Canada first applying for temporary visa for him outside Canada.
With temporary visa your child can enter the country with you and then you will apply for permanent residency for him inside Canada. I think it´s legal because your child will be born after your recieving CORP and landing.
So I believe you have chances to save your permanent status and successfully bring your new born child with you.
I would call CIC and ask questions. I´m sure their attitude will be very supportive and given advise efficient.

Did you think of staying back in the US and pursuing Green Card there instead of going through such big hassles? Your child will be American by birth and you can seek Green Card as a person with citizen-dependent. Good luck.
