Are you for real ?

If you don´t have anything valuable to contribute , stay out of this forum. They make those check-lists for kids like you.

The question of REFUND or NON-REFUND only comes when I am sold a product. If the Consulate decides my initial application is incomplete and they cannot start the processing, they have to return my money with all the documents...They cannot pocket the money and return the documents (because they have not sold me a product yet).

Some people will argue that the Consulate looked at my application so they deserve a fee. What if I didn´t include the fee with my initial application and they returned it. Do I need to send them a check separately for their work.

Think about it. Don´t blindly quote from documents. You are not the only one who understand English and can read those documents.

I would suggest you send in your application and see what happens. Simple. Then you will have your answer. No english required.

gentlemen,
Sharon have and is helpfull to all on this forum, and always advised us to the best of his/her knowledge,
dont you all appreciate all those and be thankful instead of opening an argument. Please we are all waiting and are frustrated so let us not remove it on each other specially those who like to help. Thanks and best wishes to all

Yes, I agree!

I have been in in this forum for the last 4 weeks. I agree that Sharon´s comments are not the most positive and encouraging. I also thought initially she was an immigration officer. However, I have seen her give good advise to people in this forum. I´m learning to like her comments... but it si not easy...

If you are a foreigner and have gone through immigration in the US or Canada, you will understand when I say Sharon has all the features that make a typical immigration officer: strict and cold. But a good immigration officer!!!

I actually do have first hand experience with the loss of application fees. First one was someone applying to Quebec and did not show settlement funds. They were given 120 days to provide proof of funds. It did not happen. After that, file was closed and application fees were retained by CIC.
Situation #2 - application went in with fees, they sent a letter requesting new passport photos and proof of employment. Documents were sent by unregistered post and did not arrive. Letter was received stating that the time limit to reply has lapsed, file closed, and ´please try again´. No application fee refund was offered on either occassion. The way it was explained to me by an immigration lawyer...if the application fee is refundable, there is no true motivation to make sure documents are complete and accurate. It becomes a free exercise in throwing an immigration idea at the wall to see if it will stick. It takes time away from those who are truly serious.

Like it, don´t like it, call me mother hen or whatever else you care to... that is my experience substantiated by every document I read from CIC.

But you have still not understood my question.

I am referring to the situation where the Consulate simply returns all your documents to you stating that the application is "incomplete". It does not issue a case number and does not give a timeline to send the additional documents.

I have searched the operations manuals to try and answer your question. This is what they say...you can request and recieve a application refund if YOU request it from CIC BEFORE the initial screening of the application by the visa office. page 7 -5.1
That is all that they say. The operational manuals are very helpful. Skilled worker class in OP6.

interesting note...settlement funds required have gone up to $9897 for the first applicant.

You have to learn to like Sharon´s comments. If you read between the lines, you will see Sharon has a lot to offer to anybody who asks questions.... But you have to learn to like her comments...

By first impression, one might not like her, but after carefully examining her comments, you will see a different side to and benefit from them.

Procedural manual says the following

if CIC decides the application is incomplete and return the entire application to you, you then have the opportunity to request your refund or re-submit with all the required documents. If they start the file in any way shape or form and send a request for the missing documents...your money is gone.

I think we got off to a bad start when I read your postings about being tired of all the application nonsense and being done with Canada. I would submit that your comments were pretty hostile and I reacted accordingly. My friend, when you come out swinging, it is difficult not to swing back. My apologies if I have misrepresented the kindness and tolerance of the Canadian people.

You do misrepresent the kindness and tolerance of Canadians with some of your comments. However, they are boldly truthful and correct. It´s just the way you say things...
Luckily the fallacy of composition applies to your case.

Well, I am beginning to have second thoughts about Sharon myself :)

Went through the docoument...not sure what constitutes "initial screening" though...

Suppose I file my application without enclosing my fee. They do "initial screening" and return the application to me. In this case how do they recover the cost of "initial screening" ?
