Subject: pleeease help-- I-94
  Hi!

I am an international student in Canada and have a valid study permit and student visa for Canada.

I have a tourist visa for the USA and when I came back to Canada after a five day trip by road, the Canadian customs and border person didn´t keep my I-94, he left it on my passport as such and nor did he stamp my arrival into Canada. My I-94 is valid till next four months and is it okay if I didn´t submit it the last time as I can submit it anytime before it expires, right? I hope I am not in trouble.

I understand that you are supposed to hand in the I94 to the INS officer on the US side before exiting the US if you do not plan to go back to US before expiry of I94.

If you visit US one more time before expiring of I94 you can give it to the INS officer at the port.
If you do not plan to go back , you can go to the Toronto Airport (if you are close)and give I94 to the US or even Canadian Immigration officer. The Canadian Immigration also send I94 back to US.

OR go to USINS web site, you can also mail it.

It must be given back or you may not be allowed to enter US again.

The exactly same thing happened to me when I returned to Canada from a short trip in US long time ago. And my I-94 is still in my passport TODAY! Oh my God... I totally forgot this thing! It is already expired long time ago. Am I going to be in trouble? Is there anything I can do to fix it? Please help!!! Any comment would be greatly appreciated.

Hi Pocky,
I am in the process of finding out, I called CBP number in the US and they said that I can reenter USA as mine has not expired and I can only enter through Canada.
I think your case is a bit serious as it has expired long ago. The best thing is to call this number::

"...you may call (202) 354-1000 or 1- 877-CBP -5511 Monday-Friday, between 8:30 and 5:00 Eastern Time..."

And please stay in touch we need to find a solution to this. Please do reply back to this post when u get an answer from them.

there is no clear cut laws/guidelines pertaining to I-94 when you cross -US-CANADA border. I have heard of cases where the i-94 remains in pp when you enter canada, so that you can return to US. If someone knows that he/she would not be entering usa during the validatity of I-94 shoud then he/she should surrender it at the boreder. If you have already not done so and it has expired, you can always mail to the USA authorities. Please do not lose your sleep on this and do the needful.

I think the case of Poky is different as his I-94 has expired so he needs to take special care of the whole procedure now or otherwise it will have adverse effects on his next visa or at the time of entry.

Hii... when last Week i returened to canada.. i submit my I-94 at Canadian Border.. and still it was walid for 3 months... and now i need to go back to USA next week again.. and i have a stamp on my passport which tells that expiery date of my I-94 was in sep 2006.. so what should i do... can i get another I-94 when i cross the border next week?? help me please

bhaaji,
yes i think it´s not a problem, u just have to give six dollars cash and tell them a true and valid reason of the purpose of your trip and prove it if they ask. let me know if u have any more query. you can re-enter usa and get a new I-94 as long as your visa is valid and it is multiple entry

thanx paji thanx a lot... i was realy woried about this... actuly i gave them back my I-94 by misteck... i have an court date next week and i have court letter and stuff.. so i think i have everything to prove abt my trip.. bydaway if u got any thing abt this plz let me know.. thanx paji thanx a lot

bhaaji do u have a criminal record because the border people are authorized to stop anybody from entering if they have criminal past and be truthful and honest with them, do not lie at all.
