Subject: On the verge of rejection!!!!!
  I have applied in skilled worker category in December 2003 to London CIC. For initial assessment they requested IELTS and . My points were altogether 74 along with the IELTS score of which education was for 20 points. So far everything was going smoothly. They called me for interview in Jan 2006 and at the interview they said my diploma/trade certificate is not from a govt. recognized institute in India.

They asked me to submit a letter from ministry of education, india stating the institution is an accredited one. I submitted copies of my diploma certificate attested by Ministry of External affairs, India because that what is done in India for immigration to anywhere. But they are not happy with this and want from the Ministry of education itself or govt. of Delhi. When I contacted ministry of Education, they said an educational institution cannot run in India unless they are approved and did not provide me any documentation on this regard.

Anyway, I have sent a letter stating all the above things and waiting for reply. Now they said if I am not able to provide documentation as per their request they will give only 5 points for my education with only my high school certificate, but I have done 13 years of education from govt. without the diploma, i.e.e high school plus pre-university for 3 years. i have other industry relevant international certifications from microsoft, Hp, Cisco and also 10+ years of experience as a Network Engineer. So I have again claimed at least 15 points for education. One more thing I have noticed is that in the canada immigration website, they have in nowhere stated that diplomas/trade certificates should be from govt. institutions itself, otherwise I would never have wasted my money and time on this matter. I want to know if they reject my application are there any legal claims on my part or if i can do something about this.

any advice is highly appreciated.

You have to give them what they want. Explain to the Ministry of Education in India that your application for permanent residency to Canada will be rejected unless they give you a letter stating that your institution is an accredited one. It sounds like they will most likely reject your case unless you do so. Just go to the Ministry of Education in India by yourself or send one of your relative and have them explain how important this letter is. Give them a lil bribe or ´money for chai/pani´ as we like to call it in Bangladesh :) ...always works with the government officials there. That should take care of it...and do this ASAP!! You´re in the final stages of your application, so you don´t wanna mess it up and have to start again because of some silly letter. You always give CIC what they ask for. Good luck with that and let us know what happens.

Do what ever it takes to get the paper (document with some sort of stamp), stating that this is recognized by the Govt. of India.

Just give them a paper, nobody cares how you get it or prepare it.

These visa officers are not necessarily qualified for these positions. Submit something??.
You have nothing to lose. So go ahead and do it.

Which is your institute? Can´t you get some certificate from the institute itself which shows they are govt. accredited? Or get from the institute, a copy of their accredition letter?
