Subject: Does she has to leave the country ?
  Hello,

My wife is on 6 month visitor´s visa(multiple entry) and it expires in a week. She has applied for extension(visitor´s visa) and she hasn´t received any reply yet. So, she called the CIC to find the status and they told her that it is not processed yet.

Now, what she has to do if she doesn´t get any reply before her current visa expire(which is in a week time) ? Does she has to leave the country before the visa expire or she is allowed stay her till she get reply from Canada immigration ?

BTW, we have applied for OUT-SIDE CANADA sponsorship (******NOT IN-LAND SPONSORSHIP). Her intention is to stay with me till her application processed at her home country.

Thanks
Aravind.

Normally, if you apply in time, you are in status. But, I would call them to be sure before leaving.

She cannot count on that as her husband submitted PR application AT THE EARLIER OCCASION. Barely doable, but try...who knows...

Well, when you apply for a visa extention usually a CIC officer sends his/her decision in writting.

She might remain in Canada, until she receives further notice from CIC.
(She shouldn´t leave Canada until she receives a letter from CIC).

She is not out of status because her application still in process.
However, if her application is approved she can stay in Canada of course or she will receive a letter that an interview is requeried.

In the interview she might get a visitor record with an extention OR a blue sheet that is called "Volunteer departure order"
What it means is that she has to leave Canada without prejudice.

Since you´ve already sent in the application for a visitor´s visa extension, your wife does not have to leave Canada since she has an implied status until a decision is reached on the extension application. This is what the individuals at the CIC Call Centre told me when I asked them about this same thing - I applied for permanent residence via Outside Canada spousal sponsorship and while my application was processing I lived in Canada with my husband on a visitors permit.

I didn´t have any problem getting extensions to my visitor´s permit. Nor did I ever have any problems leaving and re-entering Canada so long as I had my valid visitor´s permit/visa - so on the off chance that your wife needs to attend an interview in the states she shouldn´t have a problem getting back into Canada after it.

If for some reason your wife´s new visitor´s visa expires before she receives her PR visa, be sure to include copies of any documents you´ve received from CIC regarding her permanent residence application (and your sponsorship application) with your extension application. When I did this they extended my visa for another year rather than the usual 6 month extension.

Best of luck with everything...hopefully your wife will receive her passport request sooner rather than later.
