Subject: port of entry
  hi everyone

first i want to thank you for all the postings and advises. they really help.

my husbanding will be soon crossing the border driving budget truck.

i want to know if any one knows which port is better to cross. he will be driving from louisiana. therefore, he pretty much have some good choice. buffalo or michigan.

we will be bringing our suv, but will be included in "goods to follow" list. therefore we don´t have the exporting part now. my main concern is his usa visa is expired and i know it will not hinder him from entering canada, but i don´t want any trouble. thanks

The expired US visa does not hinder his entry in Canada as a landed immigrant.

However, once he leaves the US soil - he cannot re-enter until he has proper visa documentation. So make sure his business in US is over when he leaves as his re-entry may take some time.

With no visa it is going to be difficult. The US immigration are not going to allow him to re-enter especially with a history of extended stay on expired visa.

What nationality does he hold?

Here is your best bet:

1. Get him a U.S. visa (visit) - but it will be hard to prove why he should be allowed to re-enter with his past record.

2. You (if you hold Canadian Citizenship or have a US visa) make a trip to return the truck and pick up your remaining items in the US.

However, assume that once your husband leaves the US he will not be able to return anytime soon. Plan accordingly.

my husband holds a central Africa passport. now this is a new passport, which has no stamp on it so far. the first stamping will be entering Canada. he came to usa in 97 and remained here since then.

my question is how will they know that he over stayed in usa if they have no stamp on the passport (hoping that he will not get stamped while entering canada - by the usa authorities) as far i know that he will not be facing the usa immigration while entering canada- therefore most likely, he will not get the overstayed stamp on his new passport.

Therefore, again, how will they know that he overstayed????

But, I?m sure that they will know that he entered Canada via usa from his landed papers, and do you think that they will ask him to show his old visa (the one he was supposed to have when he entered Canada?)

by the way, i don´t drive or atleast those big trucks....so i´m out of the question....
