Subject: immigration and the child tax benefit
  I have a question I don´t know if anyone can answer. I am sponsoring my husband who is a person without status within Canada. It´s been a year since we filed with immigration canada and we are still waiting. The problem is that when I filed my taxes, they told me that they can´t calculate my child tax benefits because my husband doesn´t have a SIN number. Fine, he doesn´t have status and can´t work and under the sponsorship program I am responsible for him. But, they also told me that I have to prove he is in the country, his passport has expired as well. So, how on earth do I prove someone exists. What kind of documents do I need to come up with to prove he is in Canada and living with me. Do I need to put him in a box and mail him to Revenue Canada?

You can go with your husband to any attorney who works in any community center and ask him/her to write you an affidavit. Once you get that, your husband should go the HRDS and apply for a SIN number to get a letter of objection stating that the HRDS cannot issue him a SIN number. Then send this letter of objection to the Canada Revenue; you dont need to send off you husband with it :)

Is he legal in Canada ? I mean he is your husband ok,but how did he enter Canada > ? Did he get a Tourist visa ? Has his visa expired? Just get him a new passport through his embassy and prove his entrance by showing the entrance STAMP on his passport and give them the new passport as well ...

... i also forgot to tell you that you need to send a copy of your husband passport to the Canada Revenue.

But one thing may cause problem which is that your husband does not have a legal status in Canada.
