Subject: Complicated sponsoring story
  I came to Canada nearly five years ago as a refugee claimant and i got refused about two years later. I stayed in the country and now i am under deportation order. I got married a year ago to a Canadian citizen from St. Kitts and Nevis, and we love each other a lot. Now we are about to submit my sponsorship application, but we are not sure about a few things. She had to go to St. Kitts to help her mother, and she has to stay there for a while. Can i still apply from within Canada even is she is not in the country and i am under deportation order? Or she has to come back to do it? Or should i leave Canada and apply form St. Kitts? But I am from Hungary, so can i apply form St. Kitts? If I leave Canada and i am deported, i still able to apply from outside?

What would be the best sollution?

I am not an expert but it seems to me that your voluntary departure would be a better scenario than CIC arriving to escort you to the airport. I would make sure you have full records of your leaving.

Is your wife a PR or citizen. As a PR she must be in Canada to sponsor you. As a citizen she can apply from outside as long as she can verify that she is intending to return to Canada.

As for whether you can apply from St Kitts... I am not 100% sure. I will let someone else attempt an answer.

thanks for answering Sharon. I read that there is a possibility that i can apply even if i am deported. Is someone knows something more about it? Thanks again.
