Subject: HELP in this BACKGROUND CHECK
  i applied for my husband in Nov.2005, file went to NewDelhi in Jan. Intervied my husband in April and no reply since than. inquire in June and was told that they r investigating background check...
Does any one have any idia HOW LONG DOES IT TAKE?
Went to MP and the assistance told they cant do anything till 1 year.
is it true????
please help me in here

yes, it is true
Background checks are long and complicated (depending on your situation´s complexity (how many countries your husband previously lived in, ...))

so, pack some patience

and yes, indeed, you can not do much about it, but to WAIT

he has been in canada for 2 years on student visa.. and he lives in INDAI thats bout it.
its been 8 months since file in NEW DELHI. and its 4 months now after the interview.

There are three types of background checks.

1. Fingerprints from all countries he has lived in since age 18. I assume you had his proof of no convictions from Canada prior to submitting your application to Mississauga CPC, correct?

2. Foss check which is only a computer check to see if any Immigration Officer has written anything negative about your husband or if any enforcement action was taken against him while he was in Canada. Timeline two minutes.

3. CSIS or Canada´s KGB and their check IF requested two weeks. You could contact CSIS to see if New Delhi has even requested his security check/background check or if it is completed.

I too applied to sponsor my husband in November of 2005. We received first stage approval in July of 2006 and he was able to apply for an open work permit which he was approved for and is currently working under. It will be renewed a second time next month (August 2008) After that the file was transfered to CIC Vancouver where I was told it could take up to 16 weeks to process. After that I did not hear anything else. I would call the hotline and they would not have any new information. As of Feb 2008 I finally contacted my MP´s office and they started to look into it for us. It turns out that the file is undergoing background checks. All they could tell us was that it was active and not in a waiting pile. So in May I contacted my MP again and he looked into it again and within a week we got a call from the Border Agency doing the background checks and went in for an interview. The interview happened in June 2008 and seemed to go ok. He said he would call us if there was more information needed. After a month I called him and he said he had received the information that he needed and was currently going over it and would contact us in the next couple weeks. So so far his application has been in process for almost 3 years and the thing slowing it down is the background checks. He is from Mexico but is currently living with me in Canada. We have been married now for 4 1/2 years and have two children together! The guy from the border agency said background checks can take months or even years and there is no way to tell how long an individual file will take. Hopefully by the time you read this your husbands file will be completed!
