Subject: Re-submission and points calculation
  If for some reason the application is returned (with the fee) and you re-apply later, say after one month or so, are you now under the points calculation as of the new date of application or from the date you first applied ?
Also if your fee was not returned with the application then what is the scenario ?
Also if they are not happy with the "English proficiency" do they mention explicitly to take the IELTS ?

CIC will return your application if the ´CIC legal application´ is incomplete and there is no document proving of language proficiency. Documents are not assessed at this time. In actuality, they have not ´received´ your application into their system.

Ozz and I have debated this one to death. You have two options at this stage. You can re-submit, or totally withdraw your application and in writing, request your cheque to be returned. The onus is on you.

If application has been submitted correctly, they will cash your cheque and issue you a file number. You are now officially in their system and your application money is non-refundable.

I am of the understanding that you are assessed based on the criteria in place the date you are issued a file number. They will only ask for new or additional documents if the ones you have sent are inconculsive. That goes for language or any other documents. You do have the option of updating your file with ´new and improved´ information prior to a final decision being made but again...the onus is on you...they will not give you suggestions on how to pass.

Thanks for your quick reply Sharon.
But if they have returned the application but not the check then they must have already entered some info in their system which they can relate to the documents/application that I am re-submitting right ? So don´t you think the priority date must have been already set ?
If no, then I guess they have another intermediate process where they maintain all info till the application is ready to be accepted right ?

I think you are right. there must be some sort of internal holding system that looks after these files that are in limbo. It is not discussed on the public website but it makes sense that they do this.
