How do I start.I move from Il. to NY border to live 1 hour away from fiance in Canada. for 1 yr now. He is still married but not with her for the last 10 yrs. I and he wants me and my 2 children to move in with him. i have sole custody of 1 . the other father has no attempt of visiting for the last 1 1/2 years and no court visitation order ever. Does he still have any rights after this? (my son is 3). Im worried of him being able to cause problems with us moving if i bring it to his attention. My fiance is working on the final for divorce. What steps do i need to take next to get moving. I am an Lpn but have not been working the past year due to my fiance supporting us and we visit canada every weekend and when my 11 year old has school breaks.

He needs to complete his divorce and then apply to sponsor you and your children. Yes, the father of your children has rights, whether he sees them or not and whether or not he pays support.
