Subject: Canadian Embassy pushing me to sign waiver !!!
  First, some background people :

Name: CastAway
Date of Birth : 1971
Marital Status : single
Citizenship Status : Foreign National
Family Citizenship Status : Father, sister and brother Canadian citizens.

CastAway?s time spent in Canada :

1) 1975 - 1980
(Arrived as landed immigrant in 1975. Left Canada at the age of 9 accompanying parents abroad)

2) 1984 - 1991
(CastAway back living in Canada in 84. Dad becomes Canadian citizen in 1986. CastAway leaves Canada in 1991 at the age of 19 accompanying parents abroad...again)

3) 1998 (CastAway spends 4 months in Canada - During those 4 months he inquires about possible claims to citizenship or PR status with Immigration Canada. Is stonewalled big time. Proceeds to leave Canada.)

Problem : Is CastAway entitled to any claims whatsoever ?

Canadian Embassy is currently denying him vistor visa to attend sister?s wedding in Canada on condition that he signs a waiver of right to appeal Residency Status Determination.

Thoughts anybody?

So far I ?ve gotten pretty tepid responses from all you immigration whiz kids :

"If you have a IMM 1000 and have a single entry US visitor visa , drive into Canada and then try to fight for re-enstatment but it will take time. Can you stop earning a living and afford my fees or someone like me to fight this case?" - Genius

"In 98 pre IRPA (2002) you were only allowed to be outside Canada 183 days in each year, without a returning resident permit. So they weren´t stonewalling, as of the law at that time you had lost your PR status " - Whiz

"The CHC has determined that you have lost your PR status, and requesting that you sign the waiver so that you cannot claim PR status at the POE. You have a choice, sign the waiver or don´t get a visitor visa. You may wish to consult either a Canadian Immigration Lawyer or Consultant." - Wunderkind

"(you?re screwed CastAway), unless you can make it to a port of entry, and if you require a visitor visa, it won´t happen." - Legal Larry

Interesting. What makes you think I?m inevitably going to hit a wall with the CIC , Mich ? Take a look at Roy?s post. I think the man is friggin brilliant BTW. The guy busted this tough pinata in one swing. If I had to buy, sell or hold ROY stock, I?d be buying in truckloads !

But you make a good point tho Mich. What makes you think
family class is the way to go ?

Daddy´s can not sponsor a thirty five year old son who does not say which country he is from or if he is able to get a single entry US visitor Visa.

Either you get a US visitor Visa or you sign the waiver. This is a PR who was living outside of Canada and did not realize the new PR card was becoming a reality and he never applied for one. So now because the country of nationallity requires a CVV he can´t get on a plane without a waiver.

So if you want help send me an email directly with a whole bunch of funds and I just might take you as a client for the stock comment. MIGHT

Roy...I arrived as a landed immigrant in 1975, I left in 91 (4 months after my 19th birthday), was back in 98 for 3 months on a visitor visa and had to leave because the visa was up. During those 3 months I enquired with CIC (on a lead given to me by Customs Immigration upon arrival) about any claims I might have been entitled to at the time. They said I had none. So I left. Now, the CIC wants me to sign an OP appendix waiver. Question : Can I get re-enstated as a PR ? Is the US visitor visa my only option to get back home ?

Hi CastAway.

I suspect you have received all the freebees you are entitled to from Roy. A thank you might be in order.

You have without a doubt defaulted on your PR requirements. If you want to attend your sisters wedding - you have to make a choice. Forfeit your ´potential´ re-enstatement and attend the wedding or forget the wedding and see what you might be able to do with the assistance of a knowledgable consultant or lawyer to get re-enstated.

You obviously thought the deal was done if you have obtained a visa in the past. There is no sure deal here so the decision is yours.
