I am filipino but already a canadian citizen. i am getting married to a filipino citizen and we are planning to get married in the Philippines. I learned that in order to get married there is that I should get a ´certificate of legal capacity to marry´ from canadian embassy in manila. I would like to know if I could get the certificate from the philippine embassy here in canada instead? bcoz i dont want to waste my time in the philippines becase i´ll be there for two weeks only. Thank you very much to whose who will reply. thanks a lot!

I don´t know how this is done for Phillipines, but I do know of a friend who obtained a similar kind of certificate for marriage in China.

He went to a Chinese lawyer, paid 225 dollars and obtained the certificate. The lawyer explained the procedure and did all the necessary steps to get the certificate.

In his case, it was simply an affidavit stating certain facts about himself, such as date of birth, single status, where he lived and so on. This affidavit was signed in the presence of the lawyer, who also affixed his signature. The lawyer attached his credential as a notary public, signed by Management Secretariat Board of Toronto. These documents were filed with the Chinese consulate, who then affixed their approval on to the certificate.

I guess the procedure should be similar for Phillipines.

You don´t need a lawyer to do that. While in China, I needed such a document in order to get married. I HAD to go to a Canadian Consulate and sign a paper in front of a Canadian witness. I had to pay the equivalent of 50$C for that. But that was it. So, I wonder why you would give such an amount of money to a lawyer when you can have it for free.

In the meantime, while you are in Canada, call CIC at 1-888-242-2100 and ask them the question. May be it could be done in Canada. Be prepared to wait a long time for the line.

Good luck.

cert of legal capacity to marry (in reply to: civil wedding)
if you are a canadian citizen, you can ask the phil embassy in canada to inquire about what you need to marry a filipina.
I am a canadian citizen and I married a filipina here in Vancouver. I did not need to get that document to get a civil marriage performed.
Although you need to register your marriage to the phil embassy after you get your marriage certificate in the mail so that it will be registered also in the phil. for your spouse.
