Subject: Advice - Please Sharon
  My friends, our desperation is growing each day we don´t hear from CIC (it´s been 8 months since we submiited our application pacakge). I´m about to finish my studies in the US. Since I´m a non-US citizen, I will have to leave the US upon completion. In addition, the US government strictly prohibits me from engaging in a job while in the US. From the fellowship I had at the university I´ve been able to support myself in the US and my wife and son in Canada (they´re Canadian). As you might know it is very hard for a blue-collar single mom to make it by herself in Canada. I was counting on the PR approval by this month so I could move to Canada by Christmas, find a job and resume our lives together.

My choices are tricky:

One the one hand, if I return to my home country my case in Buffalo will not likely be transferred to another consulate closer to my home country. On the other hand, if I stay in the US I will be left without money and become an illegal allien. Worse of all, I will not be able to support my family anymore.

Is it a good idea that my wife write a letter to her MP or other authority in Canada?

I will appreciate your advice.

you have a very difficult situation in front of you. There are 2 things I would do... have your wife call an immigration consultant and have her ask your exact question. They will often be helpful without requesting payment. I would also have your wife talk with her MP. That is what they are paid for. She will need to be persistent. Ozz...is there any chance you could get a visitors visa?

I´ve considered that possibility, too. However, before we started the process I personally asked the local CIC in my wife´s city about the possibility of applying for a visitor visa while the PR was being processed. Their reply was "not possible." However, some individuals in this forum have indicated that they have being able to obtain a visitor visa while the PR is being processed. My wife and I are afraid that applying for the visitor visa might delay the PR even more...

However, as you have suggested, I will ask her to seek advice from a immigration specialist in her city. This might be the best thing to do. I´m just trying to be pro-active. I know anything can happen in two weeks, but we all know what the chances are...

they call it dual intent and CIC ´claims´ that one should not impact the other. We are trying to do the same thing. This extra wait we are facing is torture and I want Riadh to come for a visit...if they will let him.

You are still waiting for approval? For sure, a visitors visa will not impact your PR timeline. Different animal. But when you apply for the visitors visa they ask if you have any other applications before CIC. You will need to give them your file number. I would attempt the visitors visa. Your wife will need to write a letter of invitation. They explain the process very well on the CIC website.

I am not sure what you should say on your visitor application. Is the truth to your advantage... my mind says yes. However, if I try to put my CIC hat on (God help me) I wonder if by telling the whole story that you put into question your intention to leave Canada at the end of your visitors visa term. I know it is possible to get an extension. You would not be able to work while your visiting, but certainly, your PR should be well on its way through the process.

Hi,

As for what you may want to put on your application for a visitors visa, I would recommend where they ask for your reason for wanting a visitor´s visa you consider putting down:

So you can live with your wife and son while your application for permanent residence is being processed (and is finalized) by the Buffalo Regional Processing Centre.

And include your file number and, if applicable, your Client ID number.

All´s not lost; Well you have following choices:

1) If you are undergoing a "university granting" degree you should apply for a practicle training - that will allow you to stay for 1 year in the U.S. and work at will - anywhere legally. Since you are high priority case (as you have a Canadian spouse) you should get your PR in one additional year.

2) You can continue with education in the U.S. till you get your PR.

3) Apply to study in a Canadian University granting institute. But I doubt you´d get the visa as you are already applying for PR.

The visitor visa idea to Canada and then overstying will jepordize you case. That is ILLEGAL.
