Subject: Immigration and temporary visa rejections
  Hi!

Its hard getting good help!

I am a Grad student at McGill and my wife who resides in the UAE, has been rejected in 3 attempts to get a TRV so she can come here and convert to a work permit.

They say her ties to country are week, when shes been living there for 20 years ad has a job.

My question is will these rejections for TRVs affect her immigration process? Also I have the right as a student in Canada to sponsor my wife to come here. Is the embassy permitted to reject me based on the fact that Canada law allows me to sponsor her to come here!!

by your own admission you have no intentions of honouring the terms of a visitors Visa. Her ties to her husband are stronger than any job she may have and you will likely be applying for a visitors visa until the end of time with no success and CIC will be well within their rights to deny you. If you wish to see your wife, they will likely suggest you buy yourself a plane ticket.

No, a rejected visitors visa will not affect her immigration process.

Are you allowed to sponsor your wife? If she was not part of your student application as accompanying partner then the answer is no. If you are not a PR you have no entitlement to sponsor anyone.

I know this is not what you want to hear but if you want more clarification, check the www.cic.gc.ca to verify the terms of sponsorship, the rules about work or study permits. The FAQ section are very helpful.

Convert to a work permit? Why doesn´t she just apply for a Work Permit prior to applying for a visa to come here (Canada)? Maybe she´ll have better luck doing this.

Temporary Residents who arrive in Canada on a work permit accompanied by therir spoouse who are on a visitor permit, can apply for a spousal work permit within Canada.
Isn´t there a similar In-canada spousal work permit applicable to people arriving on Study Permits?

you are correct. HOWEVER, by the information in the opening thread, Faahim has come to Canada on his own - without his wife and now she would like to come and visit.

That is a very different scenario than the one you are siting. This appears to be an after the fact decision and it is proving problematic. My understanding is - (and hopefully Roy can jump in) if he wishes to have his wife join him in Canada he will need to leave the country and re-apply for his study permit and include his wife in the original application.

Hey everyone

Firstly Im sorry for a late reply to all the replies and thank you very much for them.

I would like to clarify my position in the matter, Firstly, my wife was included in my initial application for a study permit for myself and I applied exactly how one is supposed to apply as seen on the CIC website. It clearly reads that spouses of foreign students are entitled to open work permits for the duration of the validity of my study permit.

I was told bby McGill as well that she needs to apply for her visa abroad and then come to Canada and change her status while she was here.

After I had made the first application I got rejected for my study permit and she got rejected for her TRV (temp resident visa) based on our lack of ties to the country where we applied from, i.e UAE. We then submitted a second application TOGETHER and were once again rejected on the same grounds although we supplied a tonne of information tying us to the UAE.

On my 3rd attempt for a study permit ALONE without my wifes TRV, I was accepted and thus am here in Canada today.

NOW she would like to come and visit me. Of course, what I was trying to say earlier is that if the Canadian Government is allowing her to have a work permit while I am in Canada (which of course would entitle her to a TRV) why is the embassy in the UAE rejecting my application? I have only been honest with them.

My wife applied recently for a third time with a lawyer and was rejected again. Their reason for refusal is her lack of ties to the country and thus not returning. Yes I do agree that her ties to me are stronger, but if this is the case, why is the Canadian Government stating that she is permitted to stay in Canada with me while I study? Isnt this contradictory?

I did contact an MP in Montreal for advice and they have suggested applying for a work permit as opposed to a TRV directly. McGill University´s International Student Services has told me to apply for a TRV.

I am thoroughly confused. Will applying for a work permit make a difference if they feel she doesnt have enough ties to the country? I just dont know what they want to see any more!

Hi Faahim,

I want to know if your wife´s TRV/ work permit has worked out. How did you go about?

I have also applied for my study permit along with a TRV for my spouse and my application is rejected.

I am just wondering if I would face a similar issue if I apply for my study permit alone.

I guess they don´t believe the UK will allow you back at the end of your visit and you will not go back to your home country either.

Hi,

I applied for study permit along with my husband´s TRV from India. My first application got rejected (for both of us). The reason cited was that we didn´t show strong ties with home cuontry.

And then, I applied for my study permit alone and I got it. I came to canada on study permit.

After a couple of months, my husband applied for his work permit from India and it worked. He made sure that he showed strong ties (his parent´s and grand parent´s properties in India)

Hope that is helpful to some of you.
