Subject: Quebec/Canadian Marriage Certificate
  Hi, I just came across this website and it´s like a God-send because I am literally getting a headache with information overload when I go on the US gov sites!!

I live in Montreal, Canada and my fiance lives in New York. We are getting married in December, a ceremony with just immediate family, and the plan is for me to move to NY in the new year. Does anyone know if we will have any problems when it´s time to fill out the necessary NY immigration forms with a Quebec Marriage certificate? I would imagine not, but I know Quebec is considered to be "unique" so I want to be sure. We were going to do the ceremony in NY, but it´s proving to be a lot easier for me (and my family) if we do it here. Please let me know. If anyone has any other info to make this move as smooth as possible, it would be appreciated.

Thanks,
Kay, a frazzled bride!

Hi,

I don´t believe there should be any problem if you submit a Quebec marriage certificate with your U.S immigration application. All that matters to immigration officials is that the marriage is considered legal by the country in which the marriage took place.

As far as making immigration to the U.S easier - this is the best site I´ve found with immigration info;

http://uscis.gov/graphics/howdoi/spouselive.htm

The basic process is once you get married, your husband will have to file a Petition for Alien Relative (Form I-130) with all the supporting documents, once your husband files the Petition for Alien Relative you can apply for a nonimmigrant K-3 Visa (Form I-129F) that will allow you to come to the U.S to live and work while the visa petition is pending. If you don´t file for a K-3 Visa you will have to remain in Canada until the immigrant visa process is complete.

Being a U.S citizen married to a Canadian citizen, before deciding to immigrate to Canada I looked into both U.S and Canadian immigration processes. And having friends (American citizen wife, Canadian citizen husband) who are going through U.S immigration and had it take forever for him to be able to legally work in the states, I highly recommend beginning the immigration process before you move to the U.S. Not starting it prior to moving just causes a lot of problems. For example - while he is able to work in the U.S he still isn´t able to leave the country since his permaent visa is still pending and if he returns to Canada he may not be able to re-enter the U.S.
