Subject: RASOLZADEH CLASS ACTION
  There is some information posted on the CIC website for anyone interested in this situation.

How does RASOLZADEH affect us...I do not think very much. There was a major change in immigration policy and classifications in 2002. Some folks were caught in the Q and felt the changes treated then unfairly. The government has agreed and has offered to re-assess some of the claims. How many claims they are talking about is hard to tell because of several factors
1) there is a time limit for applicants to reactivate the files
2)they must still want to immigrate

They will not start addressing this situation until April 2005

How does this affect those of us who are in the current Q... again, I don´t think very much - if at all. They will likely hire additional staff to process these documents and it looks like it will take forever to work their way through them. New Police Clearances etc- what a nightmare. In some cases we are talking 6-7 years from date of application. Would you wait that long???

I would encourage us not to get too worried about this issue unless you are one of the applicants affected by this ruling. (I know... I am dreaming)

I would not waste 6 years of my life on hold. There are some other things more important to pursue than immigrating to Canada.
You gotta be crazy to wait that long time on hold...

that is what I think to and therefore the actual impact of this whole thing will not be that significant. I can´t imagine waiting that long.

Hi Sharon,

Will it going to affect a person who has recieved passport request but he did applied in year 2000.

It must be crazy stuff ? why to involve everybody in such a class action lawsuit. What if I want to opt out of it


Let us discus it How it will effect if one choose to opt out of it

I have no idea who is part of this assessment and who is not. if you are still in the system you are being assessed under the new criteria. The way the information reads, people affected by the ruling have been notified.

My lawyer told me my case was involved. Since I applied around that time and my qualification is on the borderline.

I was and am going to continue to just go ahead and do whatever I am going to do as if there is no application for immigration to Canada. Family, kids, study, personal pursits, etc.

Whatever CIC does is out of our control, but for things in our control, we got to do it. For every guy who is affected, I wish you the best luck, and have a good life during whatever long period they want to put on us.

it is a lot of reading, but this pdf article explains everything very well. There were 140,000 applications still in the CIC system when the regulations changed in 2002. This ruling means that those applicants can be assessed under the old regulations- if that is to their advantage. How many have qualified under the new points system and already hold a PR - hard to say. How many have gone on to other things in their life...hard to say. The government´s proposal is setting out how they will deal with those applicants that want to reactivate their files - that is what the processing schedule is for. All applicants were contacted by CIC who are affected. If you did not get a letter, I think everything continues on as normal.

im one whi is affected by rasolzadeh class action and applied on Dec 2001 but until now(jan 2006) i´ve not recieved any selection decision

but so many of my friends who applied in 2001 (even octobre) got the visa

i would be gald if i know anybody of you got selection decision

I applied in July 2001 from Islamabad and to this date (May 2006) no decision. By not opting-out of rasolzadeh explicitly, every case which falls into the rasolzadeh class action domian is part of it now. This was confirmed by one of the attorneys involved in the rasolzadeh class action lawsuit. So i am stuck till August 2008, as the settlement guarentees people who fall in my category under rasolzadeh will get a decision by CIC, latest by August 2008, which is 3.5 years max from the day or settlement, april 2005.

This is the most anyone will have to wait if he/she is a part of rasolzadeh.

If you opted out or do not fall into rasolzadeh, you case might be decided today or might take as long as 6, 7, 8 or even 10 years, no one knows. they are already notorious for sitting on files for way to long.

HI,

I was under the Rasolzadeh Class action and immigrated to Canada in 2007.

Now I want a apply for Citizenship. I wonder if anyone knows if under Rasholzadeh class action 2 years of living in Canada as landed immigration qualify for Citizenship?

Also I wonder if anyone has a copy of Class Action law suit to forward to me?
