What if I want to sponsor my husband to come to Canada and I am unemployed?

Hi,

As far as I know, if you´re unemployed and receiving government aid (such as welfare) you will have a problem once your husband becomes a permanent resident.

When you file apply to be your husband´s sponsor, you are basically saying for the next three years, after he becomes a permanent resident, you agree to support him. If, at any point during those three years, either you or your husband receive any financial aid from the government (such as welfare) you will be considered in default of your sponsorship and you will be required to pay back any money you receive from the government.

So even though you´re currently unemployed, you still could be his sponsor - but once your husband becomes a Canadian permanent resident you will need a job to prevent you from having to pay any money to the government.

Low Income Cutoff (Lico) Figures and Sponsorship Requirements



The following figures indicate the required income for those wishing to sponsor family members:

1) Deduct the following from the total family income:

a) Workmen´s compensation board payments, except for permanent disabilities;

b) Payments from provincial or municipal sources for welfare assistance;

c) Payments from federal, provincial or municipal sources for employment training, or for any social or welfare benefits which are not of a fixed and continuing nature.

2) Deduct all debts from the total family income.

3) The resulting amount must exceed the low income cutoff.


If the individual requiring sponsorship is married to the Canadian Sponsor or is the unmarried child under 19 years of age of a Canadian Sponsor, the guidelines are applied somewhat less stringently. Although these figures are examined, all other possible sources of income available to the Sponsor are taken into account as well, making it relatively easy to get spousal sponsorship applications approved.

Eligibility as a Sponsor:

Minimum age - 19; Canadian citizen or permanent resident; residing or intending to reside in Canada; not in prison; not bankrupt; not in default of ROLF loan or transportation loan; not under a removal order; not charged with a ?serious offence?; has signed an agreement with the individual requiring sponsorship, if the applicant is 19 or older, or if the applicant is a spouse or fiance(e); where applicable meets LICO for income generated in Canada for 12 months preceding date of undertaking (or, if visa officer requests reassessment, 12 months before immigrant meets requirements).
