US Departure report I-94

Subject: US Departure report I-94
Hi all. My name is Yuki. I got a work permit to stay in Canada. My I-94 card will expiry on Oct 28, 2006. However, my US visa has expired. Can I still go to USA before Oct 28? Thanks.

Common sense, you will not be allowed into US if you don´t have a valid visa.

I am not sure but I heard that when you have a valid I-94, entering from Canada with an expired visa is possible as long as you have not left Canada.

You should check this with the Dpt. of State web site.

using the I-94 not expired but visa expiered to reenter usa is possible only for student visa. as a student you are allowed to only stay in canada no more than 30days.also, you have to get your the back of the i-20 signed by your the students advisor befor leaving. more than 30 days you gonna have to apply for a visa to return to usa. for a vistor you can not use your i-94 with your visa expired. i advised you to return your i-94 to homeland security. if you don,t return that it is going to delay your visa processing or deny it if you have to apply for a visa next time. by returning the i-94 make sure you send the copy of your passport so they can know when you leave the country. otherwise you file is going to be recorded like you overstayed in usa. this way it will be very difficult to get an other visa. good luck

Possible, Yes.. It all depends on the immigration officer - assuming you are driving to US. I don´t think you will get to board the flight at all. One of my friends had reentered US with an expired Visa annd expired I94, with a visa renewal application receipt (in car).

But frankly, chances are low since Oct 28 just a month away and you need a damn good reason to convince the officer that you will get out of US before 28th and it is a must for you to go to US before that. Applying for extension is not an accetable reason.
