Subject: SPonsoring FAmily
  Hi there,

I would like to sponsor my parents and my brother. I just got my PR
a few weeks ago and would like to send the sponsorship application
as soon as I get my PR card in the mail, I heard it takes about
5 years to sponsor family members. Is that true?
Does anybody know if cic is gonna speed up the process any time
soon?
5 years is a loooooooooooooooonggggggg time to wait

Read www/sponsoryourparents.ca and if you can get them into Canada apply Inland under H&C grounds.

It should have been www.sponsoryourparents.ca note the following. It currently is 28 months for any sponsor to be approved by Mississauga CPC. Only then do they forward your file to ___________ for another _____ years of processing although the government says ___months any ways it?s a minimum of five years. You will have to meet the LICO at the time the visa post looks at their application.

The other option is to get them to Canada and have them apply Inland on Humanitarian and Compassionate grounds. H&C applicants have to show an Unusual or Undeserved Hardship not anticipated by the act or its regulations and in most cases not the applicants fault.

See the H&C manual www.cic.gc.ca Policy and Regulations?Policy and Program Manuals?Inland processing?IP5 H&C then read section 5.1 with further detail at section 6.7 & 6.8 but most important understand that everything must be put into the submissions and this is found in IP5 section 5.26

These are the main sections of the act:
The current CIC policy violates the following sections of Immigration and Refugee Protection Act:
? to see that families are reunited in Canada - Section 3 (1.d).
? successful integration and mutual obligations - Section 3 (1.e).
? consistent standards and prompt processing - Section 3 (1.f).
? accountability and transparency - Section 3 (3.b).
? Canadian Charter of Rights and Freedoms, including principles of equality and freedom from discrimination - Section 3 (3.d).

If a PR or CDN Citizen of Mexican ancestry or Brazilian can get his parents form Brazil/Mexico into Canada in one third the time it would take you to get your Parents into Canada that is not treating you fairly.

Denise Codere Former CIC Minister said ?The Governments intention is to treat all applicants fairly? Joe Volpe said ?Family reunification is the cornerstone of the Immigration Act? yet 30% of Brazilian parental applicants are approved in 2 months while Chinese parents take 29 months to approve 30% of those same cases.

What we need is a Fast and Fair System according to Joe Volpe former Minister of Immigration.

You should invite your parents and when they arrive here submit a H&C application based on the sections above and see if you can get every statement any politician has said about family reunification in the last twenty years.

Immigration officers have parents and normally Canadian CIC staff members know of someone in your situation or they themselves are in the same situation.

Remember you must start at how the IRPA and its regulations were created and who was the authors of the act etc. etc. If you claim something you must back it up by showing were you got this or that fact?

Compassion is common sense and quoting case law helps little because the IMM officer has a response for every federal court decision. IP5 section 5.1 refers to personal circumstances and the bond between you and your parents is what must be shown. Lawyers do not have the time to write a 40 page submission and their staff normally do all the work.

Think about it for a second all Immigration officers have parents and In-Laws and lots of time they are from another country. They know there bosses are wrong too.
