Subject: Father Sponsorship not looking promisin
  I will really appreciate your input on my fathers case below:

I started sponsoring my parents in sep 2003 .... in nov 2004 my mother passed away and i withdrew her application and continued with my fathers application .... in Nov 2005 i got a letter from cic mississauga indicatin my cut off income between sep 2002 - sep 2003 was below LICO .... they said they will send the application to my fathers home country despite not meetin the income criteria ...since i checked on the sponsorship application to contine processin despite not meetin te criteria. I am sure the CIC at my fathers home country will reject his application and i will hav to appeal. I was wonderin wat chances do i stand on appeal on the grounds of HNC, since my father is the only family relative left at my home country, my father has 3 bros, his mother 1 and sister and hey all reside in canada and they are all canadian citizens includin myself and my younger brother. My LICO is now way above the cuttof line if CIC takes into consideration my income between 2004 - 2006. Please advice wat do u reckon if this case goes to appeal wat are his chances of approval ?

Which country is your father a national?
What is the age of your father?
How healthy will your father be in three or four years?
Is it possible to get him here on a visitor visa based on the rejection rate in your fathers country?

Do you actually have a letter from CIC approving you as a sponsor or do you have a letter saying the file has been transferred to the home country?

Alfa depending on the above questions you may want to consider getting Dad into Canada and applying for PR from within Canada based on every comment any Liberal Minister of CIC said in the last twenty years about family reunification. Section 5.26 of IP5 requires H&C applicants to prove their applicants personal circumstances and the onus is on the applicant to put forth all H&C factors in their case.

Hi Roy;

My Father is Tanzanian National
His age is 64 yrs
My father has no health problems at present but its difficult to say how healthy he will be in 3 or 4 yrs
I applied for his visitors visa last month in nairobi embassy in kenya, and he was denied the visitors visa on because due to his sponsorhip application not lookin favourable and if IO grants him the Vistors visa he might not return bak to his home country, which is very bizzare coz in 2004 wen i went for my mothers funeral and then i took my dad to CIC embassy in kenya and he was granted the a single entry vistors visa & he came stayed with me for abt a yr and left canada b4 his vistors visa would expire, so he met all the criteria & he had no intention of overstayin previously then why would the circumstances change now ... please advise thanks

at the time u applied, did u think u met the LICO?

When i applied to sponsor my parents at that time, i didn´t realise that CIC is goin to assess my income goin backwords i.e. i got a permanent job in jul 2003 and i applied in sep 2003 i was just waitin for my probation period to be over.

Exactly that i did not realise & because of that ...... CIC has raised the flag ....... i will be eligible for appeal after refusal, wat are my chances on appeal base on my fathers circumstances based on the scale from 1 - 10

Anyone is basically eligable to apply or appeal the issue is whether or not you will win.

Invite dad to see the the Polar Bears in Churchill Manitoba and prey your given a CVV.

Thnx, well the problem is they will deny my father a CVV since his sponsorship is not lookin to b in his favour,,, we r stuck in a loop ..... CIC has cornered me well and proper ... one slight mistake and get prepared to get screwed up ... 4 yrs of sponsorship waitin all down the drain ... even my mother has passed away while waitin .... forget any sympathy frm CIC. Canada talks big about reunification. Section 5.26 but does not hold any weight might as well scrap this section 5.26 bull ........
