If my current employer is willing to let me work from home (Canada) & run my payroll in US (they don?t have an entity in Canada).. what are the legal implications. Is it even possible legally?

I have heard of people living in Canada & driving to us every day for work. Isn?t that a similar situation?

Roy is not everyone´s personal immigration consultant.

what I am reading in your post is Canadian tax evasion - which is very illegal.

You could be a lil polite. No one responded my posting, so I asked Roy, he is helpful & seems to be ok with question coming to him.

I have always liked your views, suggestions & contribution to this form... you are doing great but please don?t get personal.. Every one here is anxious, that is why we are here..

Could you please elaborate your reply... how is it a tax evasion... How are those people able to work who drive across the boarder to work in US.

your post was less than 12 hours old, which was the part that annoyed me. You need to give people a chance to respond - if they can. If you wish to ´demand´ service from Roy or any other professional,- you have to be prepared to get our your wallet.

Canadians who travel to the US to work, pay taxes in both countries to some degree or another. (not sure exactly how it works) The are often under a NAFTA agreement.

By the sounds of your question, you are attempting to circumvent the ´no-work´ rules set out by CIC for people here on a temporary basis or who are waiting for a spousal sponsorship to complete. You are talking about doing work in Canada without declaring the income in Canada. THAT is putting yourself in a position of ILLEGAL and could jeopardize your immigration.

This is why I asked the question "If it is legal?".

Let me clarify.. I have completed my Canada Immigration process, our visa is stamped & we (me with my wife & a kid) are planning to land within a month. I am currently in US.

When I asked my current employer that was going to quit, this is what came up in discussion that I could work from home.

I do not intend to say I don?t have work not pay taxes in Canada... This is why I used the word legal ... I wanted to know how can it be made possible legally.. I understand I could be paying taxes at both places.

I intend to be a Canadian in future.. I don?t want to steal from my future home Country.

People have international contracts all the time. I would assume you would need to become a contract employee and remit all your taxes in Canada.

I would recommend talking to a Canadian tax accountant rather than an immigration consultant about this question.

Better yet, you shouldn´t have immigrated to Canada because if this American employer dumps you [eventually] then you´ll find it impossible to get a job in Canada unless you want to sweep the streets.

Get real, don´t immigrate to Canada. So many of us have been ruined by the advice and misinformation in this forum.

why not get payroll from Banana Republic? tax haven..
register your house boat in Banana Republic, then no property tax at all..


why not do the legal way...
RRSP????? employer pension if they have a one..
that´s what I am doing now... cut down your payroll deduction..
Even people drive to U.S everyday, they have to claim their income on Feb, consider CRA regards tax on world income..but if they pay U.S payroll deduction. they could have foreign tax credit..
