Subject: Sponsoring my wife
  Hi everyone,

I am a Canadian citizen currently working (and so residing) in France. My Uzbek wife, who is currently residing in Moscow, and I are planning to move to Canada to start a new life as soon as possible.

1. How should we go about filing her immigration application to Canada (Quebec)? Should I try sponsoring her or should she file for worker class immigration, since she speaks perfect French and has a university degree? What are the chances of success and the delays that we can expect?

2. If we choose to go through sponsorship, do I have to be in Canada during this time? Ideally I would find some work in Russia (where she is living right now) and come back when her application is accepted, but is this possible? If not, can I stay in France since I am still being paid and giving back taxes in Canada? In each case, how can I prove that I will go back to Canada when her application is accepted?

3. This is a silly question when asked here, but still: is our situation too complicated that we should hire an immigration consultant to help us?

Thanks a lot,
Guillaume

Spousal sponsorship (in reply to: Sponsoring my wife)
For details, please read sponsor´s guide, see link: http://www.cic.gc.ca/english/pdf/kits/guides/3900E.pdf

First, it´s way better for her to be sponsored as a spouse. This is the fastest way and has the highest priority for immigration consideration. It usually takes less than a year and in some cases, within few months (depending on different visa offices).

You have to be residing in Canada, when she lands.

Requirements as a sponsor for Quebec is different. The federal govt has granted some autonomy to Quebec to handle certain requirements differently.

I am answering because my experience may help you.

I met my future wife in China and we married there before I came back to Quebec.

When I arrived in Quebec, I sponsored her (This is the fastest and surest way). She stayed in China because she was denied a temporary visa to come here.

Our marriage was genuine and we PROVED it with many documents : letters from friends, photos, proofs that we had lived together for a few months, family (mine and hers) gatherings, etc. Everything was translated and notarized. You must add to your application ABSOLUTELY what you can think of (very important) to prove your relation is genuine.

If you are in Canada, you send the sponsorship and the application in Missaussauga. When the sponsorship is approved, Mississauga sends the documents to Quebec. Quebec then will send you the Quebec sponsorship application (it is approved "almost" authomatically). Mississauga send the application for your wife in the Embassy in Russia.

I sent the sponsorship to Miss. 22 July and everything was over 26 October. My wife was approved in Beijing in less than 2 months. It was very fast. If you want to know about my timeline, I posted around 21 October.

All you have to do is STAY THE TRUTH, and give as many information as possible. Prepare the documentation very well. Read them many times. You do NOT need a consultant. Your case seems very clear. Again, say the truth. If you have to write letters, do not hesitate and give detail.

To prove that you will establish in Canada, you may have a job offer, a lease, etc.

You will find the documentation at www.cic.gc.ca.

Good luck.
