Subject: Does he have a chance???
  A good friend of mine has spent the last 6 years trying to get back into Canada. He first entered Canada when he was 18 to exscape felony burglary charges, lived there illegally for 3 years, had two children by canadian women and married one a week before he was deported (hoping that would get him back into the country). He served his sentence in the US and has been living on the straight and narrow except for trying to cross the border into Canada, once had his car impounded at the border. His attorney keeps stringing him along (he gets paid). Does anyone know realistically, with his background, if he would ever be let back into Canada?

from what you have described, he is criminally inadmissable - children or not. Is is still married? is his wife attempting to sponsor him?

more than likely, he is paying money for a pipe dream.

That is what I figured. He is still married but she would not be able to sponsor him, she has kids with another man now. Probably would send up a red flag or two. Thanxs for you responce.

red flag or two... how about a 4th of July celebration! besides... I cannot imagine she would want to sign a financial covenant with the Government of Canada for the guy!

I think he is out of luck.

He may NOT be out of luck, Sharon!

It depends on several factors. Because he was removed he has to do several things correctly.

First if he can get a pardon he must apply for a pardon or for rehabilitation and the form and guide are on the site at the same time his spouse sponsors him.

Then they will ask him to pay an additional $400.00 for consent of the Minister to return.

Take a look at Inland Processing Manual IP5 and section 5.19 (?) or 5.18 its still early which is best interest of the child. Is he paying support for his children.

The Legault decison from the Federal court is mentioned as research material and he should google it and read it well.

Hope his Lawyer specializes in H&C.
