Subject: Landing and return
  i am on a students visa in the US which was valid till i graduated in june 06. now i am working on Employment Authorizatio Document valid for one more year (07). i need to land for my PR in canada and come back for my work in the US. i am getting my I20 signed and stamped from my University and also getting a letter from my employer. will it be a problem getting back into the U S - I am worried because the I94 and visa are not valid but the I20 and EAD are valid. Can someone pls advise - Roy/Sharon - any comments?

If you return to the US within 30 days, expired visa shouln´t be a problem. It is called Auto revalidation. valid only if you don´t travel outside of the North America

Thanks for the reply! I am planning to fly to Toronto and back. But was wondering if it is easier to fly or drive for the return sector.

Theoretically all the same, but probably can do one thing, before departing from the US, visit the US INS office and have a record in their data base that you are leaving on that particular date. Not a must, but just to be on the safe side. Also, keep your old I-94 with you, don´t turn it to Airline or Canadian officials.

You can´t enter US without a valid visa stamped on your passport.The immigration officer will not allow you to enter US. the rules have changed you need a visa to travel back to US .the 30 day validation rule is no more in effect.

As per the website, the countries for which auto validation is not applied are Iraq, Iran, Syria, Libya, Sudan, North Korea and Cuba. Can someone pls clarify if the pp issued by countries other than above are OK to travel within North America?

I checked directly with the US consulate in Canada - they said the auto validation rule still stands so there is no need to get a new visa I can return within 30 days in to US
