Subject: Passport for Canadian-born child of Indian citizen
  I live in the U.S. and have a U.S.-born daughter with Indian citizenship (because one parent is an Indian citizen). I had no problem getting her an Indian passport from my local Indian consulate.

To my great surprise, an Indian living in Canada told me that he was NOT able to get an Indian passport for his Canadian-born daughter. The consulate told him that they don´t issue passports for Canadian-born children.

I checked the websites of Indian consulates in Canada, and indeed, they don´t have the parental declaration for passport for foreign-born Indian citizen, and they don´t have the consular birth certificate application.

Does anyone here have any experience about the this? Is it true that Indian consulates in Canada are not issuing passports to Canadian-born Indian citizens? And in that case, why do they issue passports to US-born Indian citizens, but not Canadian-born?

Yes you are damn right all those assertions but what is your friggin prob? The brat is born in Canada and instantly becomes a Canadian. If the brat decides Canada sucks, well it will have to wait till coming of age to declare his/herself not a canuck.

Yes the child becomes a Canadian, but that does not prevent him from becoming an Indian too. As I pointed out, the situation is the same in the U.S., and in the U.S. there´s no problem getting an Indian passport for the child.

The child would lose Indian citizenship only if it VOLUNTARILY acquires Canadian citizenship (for example, by applying for a Canadian passport).

As for what are the problems if the child doesn´t get an Indian passport, here are a few concrete examples: Some Indian schools will charge higher admission fees for foreigners, there are restrictions on travel by foreigners to fairly large regions of India, as a foreigner in India the child´s status and rights are not guaranteed by the Indian constitution, etc.

Parents may have many reasons for choosing an Indian passport for their child, but the main point is, it is THEIR CHOICE. The consulate cannot just decide to ignore Indian law and refuse to give passports to eligible applicants.

Again, is there any reader of this forum who´s an Indian citizen with children born in Canada and applied for the Indian passport for the children? Is it true that Indian missions there are refusing to give passports to such children?

Please post your experience.

I´ve got two daughters born in the U.S. and both have Indian passports, in spite of U.S. automatically granting mandatory citizenship to them at birth.

I got Indian passport for my daughter after so much trouble. Canadian born
It took about 3 months. I directly dealt with consular officer and pointed him constitution provisisions.

I did the samething for elder son. Now keeping the passport is a challenge.

We are thinking travel via USA with a US visa on Indian passport and land crossing using birth cert. Any thoughts ?
We have to shell out more money for airlines ?

Hello,

For those who wish to get Indian passports for their Canada/Us born kids with at least one parent being Indian Citizen.

You can get it. There are lot of folks who try to confuse you with NRI, PIO, OCI, parity etc... don´t give a crap.
purse it, let us say when baby is 2 month´s old, you will will get everything done in about 3 motnhs.

Now, Do not forget ot apply for a Visa.
If Baby is born in USA, apply for Canadian Visa on Indian passport. Canada will issue it and You can legally travel
to India via USA-Canada-India India-Canada-USA
Remember Canada-USA entry is land crossing using birth cert.
For a Canadian born kid, apply for US Visa. Using US Visa you can travel to India.

It´s all legal. check it out/
