Subject: leaving canada and coming back
  Hello,

I´m British living in Canada I have applied for PR in Canada class, sponsored by my common-law. I have received primary approval and I have my work permit, but I have to leave Canada in Dec and I am coming back in Feb. Im hoping that I will get my PR before I have to leave. But if i dont, has anybody left the country whilst still in process? Did you have trouble getting back in? Also what happens if I get it whilst im away?

Thanks for your help
Tanya

People have left the country in such situations and I would say are usually let back in BUT you should be aware that you are breaking the conditions of the application by doing so. Do you really want to risk it? I know you think it is urgent but I have known a few people miss weddings and funerals because it would be stupid to waste a year or more´s processing time not to be allowed back in. You need a final interview for inland PR (I did common law too) so you can pick up the paperwork - what if they schedule that while you´re away? You say you hope to get it before you leave, which means if you don´t, it could well come within those 2 months. Anything is possible. What if you reenter under your UK passport and then they wonder why after 6 months you haven´t left Canada again? All kinds of things to consider.

Keep in mind that you have no right to re-enter Canada. Your entry is up to the Immigration officer at the port of entry.

Only Canadian citizens and PR´s have the right to leave and re-enter Canada.

You might be allowed to re-enter but you could be refuse of entry as well.

Think about it.

. . . and if they refuse your re-entry your application is in jeapordy because you will not be able to get into Canada to attend your interview or to land. One of the disadvantages of applying inland. If you´re that close to the end, don´t risk it. All it takes is one grumpy IO and you´re SOL.
