Subject: applying spousal sponsorship before marriage
  Hi,

I´m desperately looking for some advice. I am a Canadian Permanent resident who is planning to get married with my fiance in Indonesia next year in June after a couple years of long distance relationship.

I am hoping she could come with me to Canada after the wedding and wouldn´t have to be separated again while waiting for the spousal sponsorship application. It is hard enough to be in a long distance relationship for this long already.

Is there anyway we could start applying from now? So hopefully it could be finished by the time we get married or at least not too long after that. What is the definition of common law union or conjugal partner? Can we be considered as one if we don´t live together? I have all the phone bills as proof of our constant communication in the past years, and stamps on my passport of my visits to Indonesia.

At first I thought we could just apply for a visitor visa for my wife after the wedding just so she could come to Canada then apply for the spousal sponsorship PR from within, but I just found out that they won´t issue a visa for anyone who plan to come to Canada to live here.

Any suggestions would be greatly appreciated. I personally think there is nothing worst than not being able to be with your spouse after your wedding, and that is all I wanted to avoid.

sorry to tell you - no.
you have 2 choices. a marriage based sponsorship or a commonlaw based sponsorship (have lived together for 1 year)

all your documents to prove your relationship will still be needed to prove your marriage is genuine - so hang on to them.

Your only option is to attempt to get her inside Canada on a valid visitors permit and hold the wedding here. That would allow you to apply for an inland sponsorship.

This has some pitfalls 1) she cannot work until you have interim approval 2) should CIC refuse your application you have no option for appeal and 3) the process takes about twice as long as an out of Canada sponsorship.

Grant all hope is not lost. You´re not common-law BUT-----Read http://www.cic.gc.ca/manuals-guides/english/op/op02e.pdf Conjucal partner definitions section 5.25 and 5.26 Your given name leads one to believe your not from your partners country.

Here is an option that you may wish to consider.

IF THE TWO OF YOU meet the definition submit an application now as a conjugal partner with lots of supporting documents/letters/affidavits from friends and include their status documents. Friends will not lie in a case like this. The more proof of a conjugal relationship the better. The cost of flying to Singapore from central or eastern Canada is a valid reason to go this route.

In 43 days you will be approved as a sponsor from Miss.-CPC and the file will be sent to Singapore. Processing time average 7 months. If at any time you get married submit a new IMM 008 with the appropriate status change and marriage certificate.
